- This combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The Request for Quote (RFQ) number is RFQ-056518, and is being conducted as an unrestricted procurement under the procedures of Part 12 and 13, test program, for brand-name or equal Blower Systems and accessories. The North American Industrial Classification System (NAICS) number is 333412; the size standard is 500 employees. The RFQ incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2001-24. The Federal Bureau of Investigation intends to award a Firm-fixed price type contract for the following items: Contract Line Item Number (CLIN) 001- 1265 each, National Stock Number 4240-01-442-8415 ? C420 Blower, 3 Speed; CLIN 002 ? 125 each, M-60016-001-C420 Blower, 3 Speen, w/remote cable connector; CLIN 003 ? 1390 each, m-30073-001-C420 Breathing Tube Assy, w/75 degree Swivel and cover, HSF/Cordura (Black); CLIN 004 ? 2,730 each, National Stock Number 4240-01-508-3184-Shower Cap, filters; CLIN 005 ? 110 each, M-60039-001 ? Remote Cable Assembly; CLIN 006 ? 25 each, S-30021-001 - C420 Decon Belt Assembly 70?L x 2?W; CLIN 007 ? 25 each, M45106-001 ? Blackhawk C420 Blower Pouch (Black); CLIN 008 ? 25 each, S-30020-001 ? C420 Airflow Indicator (AFI); CLIN 009 ? 300 each, M-70005-001 ? Micronel safety M95 Cartridge; CLIN 010 ? 25 each, S-10079-001 ? Molded Carry Case 19? x 14? x 7-1/8?; CLIN 011 ? 60 each, S-20040-001 ? C420 1-Position Rapid Battery Charger with two (2) each batteries and one (1) cap; and, CLIN 012 ? 4 each, S-20038-001 ? C420 4-position battery charger. If items called for by this RFQ have been identified in the synopsis/solicitation by a "brand name or equal" description, such identification is intended to be descriptive, not restrictive, and to indicate the quality and characteristics of products that will be satisfactory. Quotes offering "equal" products (including products of the brand name manufacturer other than the one described by the brand name) will be considered if such product(s) is (are) clearly identified in the quote and is (are) determined by the FBI to meet fully the salient characteristic on above products. Unless the vendor clearly indicates in their quote that they are offering an "equal" product, the quote shall be considered as offering a brand name product referenced in this synopsis/solicitation. If the offeror proposes to furnish an "equal" product, the brand name of the product to be furnished shall be provided in the quote. All quotes will be considered. If requested by the FBI, each offeror shall submit a sample of the items he/she proposes. The provision at FAR Clause 52.212-1, Instructions to Offerors (JAN 2004), and addendum is incorporated. ADDENDUM to 52.212-1, modify (b) Submission to offers: "Submit signed and dated offers to the attention of Ms. Theresa M. Powell, Contracting Officer, at via facsimile to (703) 632-1607.? modify (b)(10): The contractor shall provide the FBI with three point-of-contacts for previous contracts, either Government or Commercial, for the purpose of evaluating Past Performance." All quotes are due by 2:00 PM, EDT, 08/30/2004. Delivery of items shall be 45 days after-receipt-of-order. The delivery shall be FOB Destination to locations within the CONUS, Hawaii, Alaska, and Puerto Rico. All prices quoted shall incorporate destination charges associated with the product. Incorporated by reference are the FAR Clauses 52.212-4, Contract Terms and Conditions (JUNE 2004), and 52.212-5, Contract Terms and Conditions Required to Implement Statutes and Executive Orders (APR 2004), Subsection (a), (d), and (e). ADDENDUM to Clause 52.212-4, add 52.211-6-BRAND NAME OR EQUAL (AUG 1999); 52.216-2-ECONOMIC PRICE ADJUSTMENT - STANDARD SUPPLIES (JAN 1997); 52.216-18-ORDERING (OCT 1995); 52.233-2-SERVICE OF PROTEST (AUG 1996) and, 52.214-31-Facsimile Bids (DEC 1989). The Department of Justice (DOJ), Justice Acquisition Regulation Clauses, 2852.233-70-PROTESTS FILED DIRECTLY WITH THE DEPARTMENT OF JUSTICE (JAN 1998); 2852.201-70-CONTRACTING OFFICER'S TECHNICAL REPRESENTATIVE (COTR) (JAN 1985). Mr. Anthony Baumann, Chief Contracting Officer, Federal Bureau of Investigation, 935 Pennsylvania Ave., N.W., Washington, D.C. 20535-0001, shall serve as the FBI's contact in accordance with 52.233-3-Protest after award. ADDENDUM to Clause 52.252-5, AUTHORIZED DEVIATIONS IN CLAUSES (APR 1984), is incorporated by reference and applies to FAR Section 9.104-1, and Clause 52.212-3, Offeror Representations and Certifications (JAN 2004) apply. Each offer shall include a completed copy of 52.212-3 with their quote. FAR Clause 52.212-2, Evaluation--Commercial Items (MARCH 2001) is incorporated by reference and applies to this acquisition. ADDENDUM 52.212-2(a)--Award will be based on product, past performance and price. Past Performance and product when combined are significantly more important than cost or price. However, as quotes become more equal in their product merit, the evaluated cost or price becomes the determining factor. Past Performance will be based on telephonic performance evaluations received from previous contacts provided in the quote. Any vendor not having government or commercial experience will be rated as "Neutral." Offerors must acquaint themselves with the regulations concerning Commercial Item acquisition contained at FAR Subpart 12 and must ensure that all Representations and Certifications (located on the Internet) are executed and returned as required in this synopsis/solicitation.
