- Description
- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. FERC04C40490 is issued as a request for proposal and all provisions/clauses are those in effect through FAC 01-24. This solicitation is unrestricted under NAICS number 541. Statement of Work: I. OBJECTIVE. The Federal Energy Regulatory Commission (FERC) ensures the operational reliability and safety of each jurisdictional LNG import terminal and peak shaving facility through: a pre-authorization cryogenic design review; monthly progress reports and regular staff inspections during construction; semi-annual reports on plant operations; and annual and biennial staff inspections. The FERC is seeking a very highly qualified contractor to perform the services described in Section II and submit to the FERC staff a report on its evaluation of the FERC?s LNG cryogenic design filing/review requirements and inspection program, and to make recommendations as necessary. II. SCOPE OF WORK. The contractor shall work with the FERC staff to evaluate the cryogenic design review process and inspection program by which the FERC staff reviews proposed projects and ensures the continued operational reliability and safety of each jurisdictional LNG import terminal and peak shaving facility. The contractor shall recommend to staff any additional measures which could be used to further enhance the safety inspection program, and ensure safe design, maintenance and operating practices. The tasks to be performed include: An evaluation of the engineering and design information required of an applicant to file in its application under Title18, Code of Federal Regulations Part 380.12 in Resource Report 13; and the subsequent review criteria used by the staff to determine reliable and safe operations, and the adequacy of company operating and maintenance practices; A review of the staff?s application of the design spill criteria used to establish thermal radiation and flammable vapor exclusion zones at LNG facilities; An assessment of whether there are additional safety features or plant components that should be examined during inspections and/or application reviews; An assessment of international construction, operation, and maintenance standards and/or regulations, e.g., in Japan or Europe, that offer better protection and/or operating and maintenance measures/standards. An evaluation of the reports provided by LNG facility operators on a monthly basis during project construction and on a semi-annual basis during operations for the life of the facility, including the depth and types of information provided by the companies; An evaluation of the Cryogenic Design and Inspection Manual prepared during the design review of proposed facilities and subsequently used to evaluate facility operation; including whether there are additional facets of plant operations, maintenance procedures, or procedures that should be examined. An evaluation of the process used during inspections to evaluate plant operations, including the adequacy of the frequency of construction and operational inspections; to determine the adequacy of company operating and maintenance practices, to make decisions on the need for corrective action(s); and to follow up on recommendations. Recommendations to improve the efficacy of each component of the elements evaluated above, including standards or criteria for making evaluations and recommendations. A review of the LNG Program Manual, which documents the staff?s design review process, to determine that it accurately and completely documents the process and procedures used by the staff, and how to incorporate the recommendations of this study. III. DELIVERABLES. Based upon the analyses, the contractor shall submit a comprehensive report to the FERC staff detailing the items in Section II and setting forth technical evaluations, recommendations, and conclusions regarding the LNG facility inspection program/process. All requested topics shall be discussed in the report, which shall be considered confidential until released by the FERC. The contractor shall also complete and provide to the FERC staff an electronic copy of the report in Microsoft Word 2002 format. Deliverables shall include a contract kick-off meeting, monthly progress briefings, a draft report, a briefing of FERC staff on the draft report, an opportunity for staff comment on the draft report, and a final report. The contractor will also be responsible for conducting weekly briefings by telephone with the FERC staff regarding the progress of the analysis. IV. SCHEDULE. The contractor shall submit a schedule of deliverables including intermediate milestone dates. The draft report shall be submitted to the FERC staff no later than 120 days after the award of the contract. The report will be finalized with responses to FERC staff comments no later than 165 days after the award of the contract. All offerors and subcontractors will complete and submit with their price proposals, the Organizational Conflicts of Interest (OCI) representation and the OCI questionnaire or the OCI disclosure and the OCI Questionnaire. Also include with the price proposal a completed copy of Provision at FAR 52.212.3, Offeror Representations and Certifications ? Commercial Items (MAY 2004). Period of Performance: From approximately September 30, 2004, to March 14, 2005. FAR Provision 52.212-1, Instructions to Offerors-Commercial (Jan 2004), applies. Addendum to FAR 52.212-1 SUBPARAGRAPH (b): It is our intent to evaluate based on initial proposals. Offerors shall submit six copies of their price and technical proposal, signed by an official authorized to bind the offeror, to FERC, ATTN: C. Handley, Division of Procurement, 888 1st St., NE, Washington, DC 20426 no later than 11:00 AM local time, September 14, 2004. All questions shall be submitted to charlotte.handley@ferc.gov. Answers will be posted at http://www.ferc.gov/about/offices/oed/oed-proc.asp under Additional Information. Questions must be received no later than September 9, 2004. Price Proposal: Addendum to FAR 52.212-1 SUBPARAGRAPH (b)(6): The price proposal shall be completely separate from the technical proposal. Offerors must break out pricing by month and provide: (1) labor categories, (2) corresponding firm-fixed-price, fully loaded labor rates, (3) proposed number of hours estimated for each labor category, and (4) Other Direct Costs as applicable (subcontractor and travel). Supporting details shall also be provided as appropriate (e.g., travel destinations, number of trips, computer time and discounts offered. Addendum to FAR 52.212-1 SUBPARAGRAPH (c): The offeror agrees to hold the prices in its offer firm for 90 calendar days. V. Provision 52.212-2, Evaluation-Commercial Items (Jan 1999), applies. Addendum to FAR 52.212-2 SUBPARAGRAPH, (a) Technical Proposal: SELECTION CRITERIA. Selection will be based upon: Technical Approach (20 points) - The proposal must describe the steps that will be taken to complete each of the tasks in the scope of work. Demonstrated Experience with the Inspection of Industrial Facilities for Reliability and Safety (40 points) - The proposal must describe prior related experience and knowledge associated with inspecting industrial facilities using gas and liquid phases pressure vessels/heat exchangers and carbon and stainless steel piping, e.g., gas pretreatment and liquefaction systems; pressure relief devices and blow-down systems; hazard detection devices and control systems; computer and pneumatic process and system controls; storage tanks containing cryogenic liquids and/or other hydrocarbons, including refrigerants storage, and firewater tanks/distribution systems; LNG or other cryogenic liquid trucking; vaporization equipment; spill containment systems; marine unloading equipment for cryogenic and/or other hydrocarbon liquids. The contractor must demonstrate a practical understanding of the design of base load and peak shaving LNG plants and/or industrial facilities that have similar operational constraints, with the emphasis placed on the reliability of land based construction, operation, and maintenance of the LNG facility. Qualification of Personnel (20 points) - The proposal must describe the professional qualifications of the staff that will be assigned to this contract, including educational background, total years employed by the offeror, recent work experience, and relevant publications. Resumes shall not exceed two pages in length. Experience/knowledge of relevant standards such as Title 49, Code of Federal Regulations, Part 193 and NFPA 59A should be described. Also identify any operational experience from designing and/or working at such facilities. Past Performance (20 points) - The offeror and each subcontractor proposed must each select three references to submit a Contractor Past-Performance Evaluation. A copy of the Contractor Past Performance Evaluation form to be completed by the Offeror?s references can be found at http://www.ferc.gov/about/offices/oed/oed-proc.asp under Additional Information. The Offeror will be responsible and ensure that the completed references are submitted with the technical proposal. Offerors should also notify the references that FERC may be contacting them regarding the past performance information. Addendum to FAR 52.212-2 SUBGRAPH (a): Technical and past performance, when combined are more important than price. However, the award shall be made to the offeror whose proposal is determined to best meet the needs of the Government after consideration of all factors, i.e., provides the ?best value?. ?Best value? for the purposes of the contract is defined as the procurement process that results in the most advantageous acquisition decision for the Government and is performed through an integrated assessment and trade-off analysis between technical and price factors. Clause 52.212-4, Contract Terms and Conditions-Commercial Items (OCT 2003) applies. Addendum to FAR 52.212-4: 1. 52.252-2 Clauses Incorporated By Reference (FEB 1998): This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text.
