Description
The purpose of this Amendment 0003 is to respond to vendor questions received to date on Solicitation SP4700-04-R-0029. QUESTION #7: This statement: Only Sun iForce Partners will be considered. This is a restraint of trade. SUN systems products and support can be acquired on the open market. Please revise your specifications on the opportunity to reflect such. ANSWER: Unauthorized Sun resellers can not meet the requirements of this bid---to provide a valid Solaris license, standard warranty of Sun gear by Sun personnel, and the legal transfer of Sun intellectual property. Sun requires the government to purchase from a "Sun Government System Provider." This is the only way to properly transfer Solaris licenses, Warranty, and other intellectual property associated with the hardware is to buy this way. A Government Systems Provider (GSP) contract is executed between Sun and the VAR. There are significant terms and conditions (as well as indemnifications clauses) that protect the investment as a customer that these VARs sign up to. Any company can get on the list. If you have not purchased products through one of Suns GSPs you are not properly acquiring the Solaris license, Warranty, and other intellectual property associated with the hardware. The Sun GSP contract only allows for ONE tier of transfer (directly to a government customer). The government will not be licensed properly for Sun software and would incur an additional charge; the standard warranty would also be void. Offers are due 8 Sep 04, 11:00 a.m.., Andrew T.
