Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This acquisition is issued as a Request for Proposal (RFP). The combined synopsis/solicitation number is W91ZLK-04-T-0778. This solicitation document and incorporated provisions and claus es are those in effect through Federal Acquisition Circular (FAC) 97-27. The associated North America Industry Classification System (NAICS) Code is 336411 and the Business Size Standard is 1,500 employees. The contractor shall provide the Airbus in a ccordance to the statement of work. THIS PROPOSAL SHOULD BE GOOD FOR 3 MONTHS. OBJECTIVE. The Aberdeen Test Center (ATC) plans to purchase one (1) used Airbus A300 (any series) airframe in the passenger aircraft configuration for destructive testing. T he A-300 aircraft purchased shall be in the passenger aircraft configuration and include all passenger cabin interior furnishings (gallies, lavatories, walls, partitions, doors, seats, etc) and cargo compartment interior components (liners, container loadi ng/restraint systems, etc). The number of cycles and aircraft age is not specified but will be required to be disclosed prior to purchase. The aircraft shall be in a flight-worthy condition that enables delivery to destination Phillips Airfield, Aberdeen Proving Grounds, Aberdeen MD. INTRODUCTION. Under a contract between the U.S. Government and contractor a used Airbus aircraft (Passenger configuration) will be purchased. All logistics of the delivery location of the aircraft, parts to be retained, and parts to be removed will all be negotiated within this contract. REQUIREMENTS. GENERAL. The Contractor shall provide all required resources to accomplish the tasks described herein.TASKS. Upon delivery of the aircraft, contractor shall be responsible for the cleaning of all trash, remaining food, and de-service all lavatories.Contractor shall remove and retain certain parts, materials, units and/or assemblies from the aircraft of which the airframe is a part. Such part, material, unit or assembly removal may consist of any parts not specifically described below.The following items will remain intact:the complete landing gear assemblies; all passenger, emergency exits and cargo hold doors and associated mechanisms for opening, closing and latching; the fli ght deck door and bulkhead structure; all overhead passenger stowage bins; all passenger seats; all cargo compartment cargo handling mechanisms and liners; all aircraft environmental and venting systems; all flight deck and passenger windows,all main deck sidewalls panels. Notwithstanding the above, contractor may, within 60 days following the delivery of the aircraft to the delivery location, elect to retain certain parts, materials, units and/or assemblies. To accommodate this activity, the contractor shall have 30 days of unlimited access to the airframe following delivery to Phillips Airfield (the Decommissioning Period) Such removal shall be subject to the following conditions. First, the retention and removal activity must not materially adversely impact ATCs testing activities. Second, contractor must replace the parts, materials, units and/or assemblies with like parts, materials, units and/or assemblies that are of sufficient utility to permit the retention of the physical integrity of the syst ems(s) affected. For the avoidance of doubt, any substituted parts, materials, units and/or assemblies that are being substituted may be supplied in an unserviceable condition. Also, any substitution of an essential item will be at contractors expense. At delivery, the governments inspection of the airframes logbook shall confirm that the airframe has no operational history of open logbook discrepancies in dicating pressurization problems. As such, the contractor shall believe at delivery that the airframe will be capable of being pressurized (using an outside air supply furnished by the government or its agent) so as to support a minimum differential of 7. 5 psi as compared to outside air pressure.The following documents shall be delivered with the airframe:FAA Approval Flight manualMaintenance manual  Aircraft Illustrated Parts Catalog  Aircraft Wiring Diagrams  Aircraft Latest Weight and balance reportA ircraft Structural repair manual (SRM)Record of all major repairs and related supporting documentationAircraft Flight Log (Showing date of last flight and aircraft times and cycles)All other historic records that are available (Including aircraft birth re cords as delivered with the aircraft)Items marked with may be hard copy or microfilmItems marked with shall be certified by the contractor. Aircraft must possess current airworthiness certificate and currently be listed on the FAA registry. ATC agrees t hat contractor may, upon delivery, remove other materials including but not limited to: engines, the auxiliary power unit, all avionics and instrumentation, flight control surfaces, hydraulic system components, electrical system components, and interior c omponents. These items will remain the property of contractor at all times. The contractor agrees to remove these items within 30 days of delivery of the airframe, or longer, whatever the parties agree to in writing. The contractor shall notify ATC in wr iting in the event that the aircraft cannot be delivered by contractor to ATC by Date contractor due to force majeure or to destruction of or damage to the aircraft of which the airframe is a part prior to delivery to ATC. In the event that the airframe i s damaged beyond reasonable economic repair, this agreement will terminate, without liability or obligation on the part of either party, except that contractor will refund to ATC any sums received by contractor in payment of the purchase price of the airfr ame.Upon receipt of the total purchase price by contractor, the contractor shall deliver to ATC an Airframe Warranty Bill of Sale (with such warranty running only as to title) for the airframe.The contractors service shall provide aircraft orientation tra ining to the ATC personnel at Phillips Airfield. Such training shall include (but not be limited to) how to open/close passenger and cargo doors, general safety, aircraft pressurization, external electrical power operation, etc. The contractor shall facil itate and liason with ATC to coordinate ATCs inspection of the airframe, and any records relating thereto and sold therewith. ATC will review and accept all documents prior to delivery. ATC will conduct its final inspection and final acceptance of the a irframe and any records relating thereto and sold therewith, prior to delivery of the airframe to Phillips Airfield. ATC will assist or be responsible for the tasks described below:ATC will make all necessary arrangements to allow contractors representati ves access to the aircraft and to permit contractor to bring certain tooling and equipment to the delivery location to facilitate the removals cited above.ATC must within one day after the closing date deregister from the FAA registry the aircraft which th e airframe is a part. ATC agrees that it will take the following actions to immediately deliver the following to the contractor within 30 days after delivery, and will reasonably cooperate to terminate any or all of the same as the contractor may request airframe/aircraft data plate,airframe/aircraft sanitary certificate,airframe/aircraft airworthiness certificate,radio license and authorization; and,airframe/aircraft registration certificate.ATC will not conduct any destructive testing on the airframe unt il such deregistration and removals cited in section above have been completed ATC will reasonably assist, as requested, the contractor in removing those parts of the airframe to which contractor will retain title (including, without limitation, aircraft engines, auxiliary power unit, avionics, and those items that the contractor may remove or replace as provided above. ATC intends to use the airframe solely for destructive testing purposes and ATC agrees that it will not allow the airframe, nor any of its component parts (other than those items contractor retains prior to the commencement of such destructive testing) to be used on any aircraft by any party. If required by the contractor prior to the commencement of any testing of the airframe, ATC agrees that it will either (i) paint the airframe in standard aircraft white, or (ii) remove all paint on the airframe so as to cover any distinctive markings included in contractors livery (including distinctive paint scheme and any logos visible on the exterior of the airframe). ATC will take further actions to alter the appearance of the airframe as contractor may reasonably request, as to minimize or eliminate any public recognition that the airframe was previously owned or operated by contractor. ATC agrees, upon closing, the airframe will be deregistered as defined in above section. ATC will not operate the airframe or any part thereof on or as an aircraft, and buyer will not allow any third party to use the airframe as an aircraft. ATC will also provide the contractor with the airframe manufacturers data plate and certificate of airworthiness upon closing. These items will remain the property of contractor. ATC acknowledges and agrees that, without prejudice to any other right contractor may otherwise enjoy under this agreement (including rights in equity and at law), contractor will be entitled to immediate injunctive action in the event that ATC (or any th ird party) attempts to operate the airframe as an aircraft. PERIOD OF PERFORMANCE. Shall be for a period not to exceed 3 months. Acceptance shall be at Destination. Shipping shall be FOB Destination. The following clauses will be incorporated by refe rence. 52.209-6 Protecting the Governments Interest When Subcontracting with contractors debarred, suspended or proposed for debarment. 52.212-4 Contract Terms and ConditionsCommerical Items, 52.223-11 Ozone-Depleting Substances, 52-247-34 F.O.B. Desti nation, The provision at 52.212-1, Instructions to Offerors--Commercial, applies to this acquisition. The provision at 52.212-2, Evaluation--Commercial Items is applicable to this acquisition. The specific evaluation criteria to be included in paragrap h (a) of that provision are as follows: Technical, past performance and price. Technical and Past Performance when combined are significantly more important than cost or price. The government is not responsible for locating or securing any information, wh ich is not identified in the proposal. Past performance will be evaluated based on information provided by the offeror as to actual sales of the proposed products to industry or government agencies. Past performance will consider the ability of the offero r to meet the delivery schedules, warranty, and support. The government will award a contract to the offeror whose offer conforms to this solicitation and will be most advantageous to the government, price and other factors considered. The government res erves the right to make an award without discussions. Offeror shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications--Commercial Items, and DFARS 252.212-7000, Offeror Representation and Certification with its offer. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders--Commercial Items, applies to this acquisition.
