Description
The US EPA Office of Pesticide Programs/Environmental Fate and Effects Division (OPP/EFED) is seeking to acquire technical support in assessing the fate and transport of pesticides in the environment. Pesticides are regulated under several laws, primarily the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) which authorizes EPA to oversee the registration, distribution, sale, and use of pesticides. The Office of Pesticide Programs (OPP) is responsible for regulating pesticides through the processes of registration, review, and re-registration. Registrant studies are conducted using OPP developed data requirements and guidelines?and along with other applicable information, the data generated from these studies are used to assess the potential impact of pesticide use on human health and the environment. To ensure appropriate quality assurance, this data is further evaluated for adequacy and validity prior to conducting risk assessments. Following these evaluations, the data is used for human health and ecological resource risk assessments. OPP also convenes scientific workshops and seminars to discuss and resolve scientific issues associated with the registration, registration review and re-registration of pesticides. This requirement shall provide support primarily in the areas of: (1) the review and evaluation of available data pertaining to the chemistry and fate of pesticides in the environment (including environmental monitoring data); (2) the valuation of environmental risk from pesticides, and; (3) assessment of pesticide fate and transport in the environment. This requirement shall also provide occasional support to EPA in the researching of pesticide fate and transport science policy issues and the development of science policy options for evaluation and consideration by EPA. In accordance with Federal policy under FAR?Part 37, the proposed work under this contract is considered "performance-based." The potential contract will be categorized as a Cost Plus Fixed Fee (CPFF) type with a 12-month base period and four 12-month option periods with an estimated total labor quantity of approximately 22,000 hours per period. This procurement is classified under North American Industry Classification System (NAICS) Code 541620, entitled "Environmental Consulting Services." The size standard for this industry classification is $6.0 million for potential small and small disadvantaged businesses. This requirement is currently being performed under EPA contract 68-W-00-070. Dynamac Corporation, the incumbent under that contract, will be ineligible to compete as the prime contractor for this action due to its status as a large business. This action is being conducted competitively as a total small business set aside in accordance with Federal Acquisition Regulation (FAR) Subpart 19.5. Competition is limited to qualified small business concerns as defined by the criteria and size standards in 13 CFR Part 121 (also see FAR Part 19.102) at the time of submission of offer. The Request for Proposals (RFP) shall be posted on the Internet on or about November 9, 2004. Proposal submission shall be due forty-five (45) calendar days after the RFP issuance date. SUPPLEMENTARY STATEMENTS TO OFFERORS A. Percentage of Work to be Performed, and Use of Consultants: The offeror is advised of the language under FAR Clause 52.219-14 "Limitations on Subcontracting" paragraph (b)(1) which states that under a contract for services "at least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern." The final proposal should realistically demonstrate how the offeror will be able to comply with this clause. Additionally, please note that consultants are considered subcontractors and not employees of the prime contractor. Therefore, consultants are considered as part of the work being subcontracted. B. Guidance for Performance-Based Service Contracting (PBSC): As noted, the proposed work under this contract is being considered "performance-based." In general, performance-based contracting methods are intended to ensure that required performance quality levels are achieved and that total payment is related to the degree that services performed meet contract standards. Performance-based contracts, (a) Describe the requirements in terms of results required rather than the methods of performance of the work, (b) use measurable performance standards (i.e., terms of quality, timeliness, quantity, etc.) and quality assurance surveillance plans, and (c) specify procedures for reductions of fee or for reductions to the price of a fixed-price contract when services are not performed or do not meet contract requirements.
