- NASA/MSFC has a requirement for the purchase of an Environmental Protection Agency (EPA) accepted Software Package specifically designed for Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) activities. MSFC is responsible for determining characterization of both organic (volatiles) and inorganic (metals and general chemistry) chemicals from potentially hazardous site samples in compliance with the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). MSFC?s Environmental Laboratory is currently pursuing recognition by the EPA by obtaining a National Environmental Laboratory Accreditation Certification (NELAC). In order to accomplish this task, MSFC must utilize EPA recognized Contract Laboratory Program (CLP) software package specifically designed and scalable for EPA CERCLA reporting and characterization of both organics (volatiles) and inorganics (metals and general chemistry). In addition, this software package must be designed and scalable for a relatively small laboratory (5 persons), and independent of procuring a complex and non-essential Laboratory Information Management System (LIMS), but including the capability for rapid electronic data review/validation coupled and integrated into the electronic data deliverable system. NASA/MSFC intends to purchase the items from Environmental Information Systems, Corporation (EISC) located in Las Vegas, NV. This recommendation is made pursuant to FAR 13.106-1(b)(1) for the acquisition of supplies or services determined to be reasonably available from only one source. EISC offers an EPA-accepted scalable contract laboratory program software package which allows MSFC to acquire only the Volatiles (organics), Metals and General Chemistry (inorganic) Analytical Review software modules from a larger total package. This is the only known source that provides the necessary flexibility for MSFC to obtain only the required modules which are currently necessary for reporting to EPA. Since MSFC currently does not have a requirement to test other samples such as pesticides or semi-volatiles, acquisition from another source would mean MSFC would be required to purchase two additional unnecessary software systems/modules. Also, EISC is the only known vendor that provides a CLP software package to a laboratory without the purchase of a LIMS. Therefore, the EISC software would not require the purchase of extra non-essential equipment. EISC is the only known vendor who can satisfy MSFC?s technical requirements as follows: (1) Capable of producing a quick data validation in 90 seconds and complete report generation in 20 minutes; (2) Provides a scalable software package; (3) Works with a laboratory of only five employees, (4) Provides both organic and inorganic chemical analysis and validation electronic software, and (5) Does not require an unnecessary and complex upfront network system tying all of the laboratory equipment together. The Government intends to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on November 4, 2004. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the agency. An Ombudsman has been appointed.
