Description
The Military Sealift Command (MSC) is conducting market research into commercial contracting practices of firms that perform ship repairs. We want to identify commercial practices that might be appropriate in government contracts using FAR Part 12 (Acquisition of Commercial Items); these contracts use terms and conditions that more closely resemble those used in industry. This market research is for informational purposes, and there are no funds available to pay for the cost of preparing responses. We are looking for commercial practices and contract terms for inspection, manner of performing work and acceptance; facility certification requirements; contract changes; title; warranty; liability insurance; guarantees; data, and access to vessels that address (in whole or in part) issues in Government clauses currently used for ship repairs. The Government clauses (listed below) are available at http://farsite.hill.af.mil/Vfdfar1.htm. (1) 252.217-7003, Changes. (2) 252.217-7004, Job Orders and Compensation. (3) 252.217-7005, Inspection and Manner of Doing Work. (4) 252.217-7006, Title. (5) 252.217-7007, Payments. (6) 252.217-7008, Bonds. (7) 252.217-7009, Default. (8) 252.217-7010, Performance. (9) 252.217-7011, Access to Vessel. (10) 252.217-7012, Liability and Insurance. (11) 252.217-7013, Guarantees. (12) 252.217-7014, Discharge of Liens. (13) 252.217-7015, Safety and Health. (14) 252.217-7016, Plant Protection, as applicable. Request interested firms provide the following information via facsimile or e-mail to Susan Marie Paolini by 15 Dec 04 (Phone: (202) 685-5930; Facsimile: (202) 685-5942; e-mail: susan.paolini@navy.mil). (1) Name of firm and point of contact (including phone and e-mail) (2) Size status of firm (e.g. small business, hub zone) (2) Brief description of firm's ship repair capabilities (3) Standard terms and conditions for commercial customers (e.g., sanitized contract language) (4) Customary practices regarding negotiating, modifying or tailoring of contract terms and conditions to meet customer needs (5) Best commercial practice recommended for consideration by the Government (6) Indicate if your firm is interested in providing further feedback related to development of FAR Part 12 (Commercial Item) solicitation terms and conditions.
