Description
THIS AMENDMENT EXTENDS THE DEADLINE TO DECEMBER 13, 2004 AT 4PM. NO OTHER CHANGES ARE MADE. This is a combined synopsis/solicitation for commercial items prepared per the format in Subpart 12, as supplemented with additional information included this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number INL- 0118-2033N4 is a Request for Quote (RFQ). The Government intends to award a firm, fixed price contract for the acquisition of one light turbine powered helicopter. Questions regarding this synopsis/solicitation must be submitted in writing via email to hayes-crowmp2@state.gov no later than 12/3/2004. The following Provisions and Clauses are incorporated into this RFQ by reference. No addenda apply to these Provisions and Clauses. FAR 52.212-1, Instructions to Offerors – Commercial Items, FAR 52.212-3, Offeror Representation and Certifications – Commercial Items, FAR 52.212-4 Contract Terms and Conditions – Commercial Items, FAR 52-212-5, Contract Terms and conditions required to Implement Statutes or Executive Orders-Commercial Items. No additional FAR clauses apply. STATEMENT OF WORK/SPECIFICATION (a) PURPOSE: The Bureau for International Narcotics and Law Enforcement Affairs, U.S. Department of State has a requirement to: provide one new or used U.S. manufactured light turbine powered helicopter to the Ecuadorian National Police (ENP) in support of counter narcotics missions of reconnaissance, surveillance, rescue and command and control operations. (a) SCOPE OF WORK: The helicopter shall be a commercial, "off-the-shelf" model. It must be equipped with wide-band communications equipment to enhance counter drug efforts. The helicopter shall be able to operate in extreme variations of altitude (sea level to 14,000 ft.) and in temperatures (ISA + 28). (b) TECHNICAL REQUIREMENTS: (i) The helicopter shall be of U.S. manufacture and must be certified by the FAA for day, night operations. Also helicopter shall be equipped with Instrument Flight Rules (IFR) instrumentation. (ii) The helicopter shall be free and clear of all liens. (iii) The helicopter shall be a new or used model that meets the minimum specifications listed in (d) below. (iv) The helicopter’s engine and all aircraft components shall have remaining at least 50 percent of its flight “time remaining before overhaul” (TBO). (v) The helicopter shall not have been involved in any accident that required any structural repairs. (vi) The helicopter shall have an internal APU or a starter generator sufficient for starting engine without auxiliary power. (vii) The helicopter shall have installed dual flight controls. HELICOPTER SPECIFICATIONS: The helicopter shall meet the following minimum requirements upon delivery: (i) Capability - · Doors-off operation with no significant performance reduction / limitations and no significant impact on operating weight performance (significant is defined as capable of maintaining at least 90 KIAS while operating at no less than 75% of the helicopter’s maximum operating weight for any flight configuration/envelope as per the manufacturer advertised performance capabilities - (operating weight defined as: sum total weight of basic aircraft, mission equipment, crew, baggage, fuel, water and oil). · Crashworthy fuel bladder and auxiliary fuel cells (if installed) that meet FAA requirements. · Capable of 10 degrees plus slope landings (lateral). (ii) Performance – · HIGE, ISA +20 Degrees C 14,000 ft. (at operating weight) (at operating weight with a 2.5 hour minimum flight endurance · HOGE, ISA +28 Degrees C 4,000 ft. (at operating weight) (at operating weight with a 2.5 hour minimum flight endurance. · (iii) Avionics and Navigation System – · Navigation System, including GPS, with the following minimum mandatory requirements: a) VOR/DME; b) ADF (automatic direction finder); and c) Gyro Compass · HF and VHF radios. VHF radio must be compatible with in-country ATC frequency ranges. · Radar altimeter · Transponder w/altitude encoder (iv) Seating for a maximum of seven (including pilot) with unobstructed visibility so that all normal helicopter operations can be conducted from either the pilot or co-pilot station. (v) Engine / airframe: All mandatory AD and/or SB’s complied with. There shall be no mandatory service bulletins or airworthiness directives due or overdue at the time of delivery of all aircraft. (c) DOCUMENTATION: (i) Log Books and Records – All helicopter, engine, and mission equipment records with respect to maintenance and modifications shall be provided. The helicopter shall be delivered with the following documentation: A complete set of factory original up-to-date manuals including all applicable helicopter and equipment historical records, weight and balance, minimum equipment list, flight manual, maintenance manuals, illustrated parts breakdown manuals, inspection guides, drawings, and wiring diagrams. (f) DELIVERY: All items shall be priced FOB Quito, Ecuador. The Government requires the aircraft be delivered within 60 days of contract award. The contractor shall be responsible for the export license and all export licensing matters. The U.S. Government will exempt the contractor from custom(s) duties and taxes due to the pertinent foreign countries. (h) WARRANTY: The contractor shall provide its commercial warranty on the helicopter and all installed equipment. (1) 52.212-1 Instructions to Offerors--Commercial Items. (Oct 2000) (a) North American Industry Classification System (NAICS) code Standard industrial classification (SIC) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees. (b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show-- (1) The solicitation number; (2) The time specified in the solicitation for receipt of offers; (3) The name, address, and telephone number of the offeror; (4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary. Pictures of aircraft exterior, interior, cockpit, and ground support equipment are encouraged. If subcontractors are proposed, submit name, address, and telephone number of the subcontractors; (See (2) 52.212-2 (a)(i) Evaluation of Commercial Items for information that needs to be submitted.) (5) Terms of any express warranty; (6) Price and any discount terms; (7) "Remit to" address, if different than mailing address; (8) A completed copy of the representations and certifications at FAR 52.212-3; (9) Acknowledgment of Solicitation Amendments; (10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information) (See (2) 552.212-2 (a)(ii) Past History of the Aircraft for information that needs to be submitted in lieu of information required herein); and (11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration. (c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation. See addenda (k)(1). (d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing. (e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately. (f) Late submissions, modification, revisions, and withdrawals of offers. (1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt of 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due. (2) (i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and – (A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or (B) There is an acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or (C) If this solicitation is a request for proposals, it was the only proposal received. (ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted. (3) Acceptable evidence to establish time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by installation, or oral testimony or statements of Government personnel. (4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume. (5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer. (g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received. (h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer. (I) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to-- GSA Federal Supply Service Specifications Section Suite 8100 470 East L'Enfant Plaza, SW Washington, DC 20407 Telephone (202) 619-8925 Facsimile (202) 619-8978. (ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision. Additional copies will be issued for a fee. (2) The DoD Index of Specifications and Standards (DoDISS) and documents listed in it may be obtained from the-- Department of Defense Single Stock Point (DoDSSP) Building 4, Section D 700 Robbins Avenue Philadelphia, PA 19111-5094 Telephone (215) 697-2667/2179 Facsimile (215) 697-1462. (i) Automatic distribution may be obtained on a subscription basis. (3) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance. (j) Data Universal Numbering System (DUNS) Number. (Applies to offers exceeding $25,000.) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "DUNS" followed by the DUNS number that identifies the offeror's name and address. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet to obtain one at no charge. An offeror within the United States may call 1-800-333-0505. The offeror may obtain more information regarding the DUNS number, including locations of local Dun and Bradstreet Information Services offices for offerors located outside the United States, from the Internet home page at http://www.customerservice@dnb.com. If an offeror is unable to locate a local service center, it may send an e-mail to Dun and Bradstreet at globalinfo@mail.dnb.com. (End of provision) (k) Addenda (1) Period for acceptance of offers.The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers. (2) 52.215-5 Facsimile Proposals (OCT 1997) (a) Definition. “Facsimile proposal,” as used in this provision, means a proposal, revision or modification of a proposal, or withdrawal of a proposal that is transmitted to and received by the Government via facsimile machine. (b) Offerors may submit facsimile proposals as responses to this solicitation. Facsimile proposals are subject to the same rules as paper proposals. (c) The telephone number of receiving facsimile equipment is 202-776-8686. (d) If any portion of a facsimile proposal received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document – (1) The Contracting Officer immediately shall notify the offeror and permit the offeror to resubmit the proposal; (2) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the offeror; and (3) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timeliness, provided the offeror complies with the time and format requirements for resubmission prescribed by the Contracting Officer. (e) The Government reserves the right to make award solely on the facsimile proposal. However, if requested to do so by the Contracting Officer, the apparently successful offeror promptly shall submit the complete original signed proposal. (End of provision) (3) DOSAR 652.206-70 COMPETITION ADVOCATE/OMBUDSMAN (AUG 1999) (a) The Department of State's Competition Advocate is responsible for assisting industry in removing restrictive requirements from Department of State solicitations and removing barriers to full and open competition and use of commercial items. If such a solicitation is considered competitively restrictive or does not appear properly conducive to competition and commercial practices, potential offerors are encouraged to first contact the contracting office for the respective solicitation. (b) The Department of State's Acquisition Ombudsman has been appointed to hear concerns from potential offerors and contractors during the preaward and postaward phases of this acquisition. The role of the ombudsman is not to diminish the authority of the contracting officer, the Technical Evaluation Panel or Source Evaluation Board, or the selection official. The purpose of the ombudsman is to facilitate the communication of concerns, issues, disagreements, and recommendations of interested parties to the appropriate Government personnel, and work to resolve them. When requested and appropriate, the ombudsman will maintain strict confidentiality as to the source of the concern. The ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of formal contract disputes. Interested parties are invited to contact the contracting activity ombudsman, Ms. Cathy Read, at (703) 875-6639, or by fax at (703) 875-5005. Concerns, issues, disagreements, and recommendations which cannot be resolved at a contracting activity level may be referred to the Department of State Acquisition Ombudsman at (703) 516-1680, by fax at (703) 875-6155, or write to: Department of State, Acquisition Ombudsman, Office of the Procurement Executive (A/OPE), Suite 603, SA-6, Washington, DC 20522-1602. DOSAR 652.206-70 Offerors are advised to include on the exterior surface of the envelope containing the offer all information required by the “Submission of Offers” provision of this solicitation. (2) 52.212-2 Evaluation – Commercial Items (Jan 1999)- (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation and is the most advantageous to the Government, price and other factors considered. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. The evaluation factors used in this solicitation will be rated acceptable/unacceptable. An unacceptable rating on any factor will be cause to remove the offeror from further consideration. All technically acceptable, responsible offerors will be placed in the competitive range and total price will be the deciding factor. The following is a breakout of the evaluation factors: (i) Ability to meet Statement of Work/Specification requirements. Provide a technical description of the aircraft being offered in sufficient detail to evaluate compliance with the requirements of the solicitation. Each offeror shall provide sufficient data to substantiate the offerors ability to meet all requirements of the Statement of Work/Specification. The offer shall provide evidence of clear title to each aircraft and the ability to obtain a release of any secured title. (ii) Documentation verifying that each aircraft meets the technical requirements. (iii) Ability to meet the delivery schedule. (b) Aircraft Inspection. The Government reserves the right to inspect the aircraft and records if deemed necessary by the Government. The aircraft and its records shall therefore be made available for inspection so that the Government may perform inspection(s) and then have the ability to accept. The offeror and the Government shall agree upon the site and time. All travel expenses for Government personnel shall be at the expense of the Government. All travel by the offeror shall be at the offer’s expense. As required by the Statement of Work/Specification, the aircraft shall be fully operational and airworthy, and certified by the Federal Aviation Administration. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Offerors must provide a completed SF 1449 and completed Representations and Certifications per FAR 52.212-3 with their quote. The Government will make one award from this synopsis/solicitation. Offerors must be registered in the Contractor Central Registry (CCR) to be considered for award.
