- 17) This is a combined synopsis/solicitation to procure commercial items prepared in accordance with the format of FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are not being requested and a written solicitation will not be issued. This solicitation is being issued as a Notice of Intent (NOI5019). This solicitation and its incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 01-25. The National Institute of Allergy and Infectious Diseases (NIAID) intends to procure maintenance on a sole source basis using Simplified Acquisition Procedures with Rigaku for a period of twelve months for x-ray diffraction units. The instruments to be covered are the 1) RAXIS IV; 2) UD2792N; 3) RU200; 4) OD23093; 5) RAXISIV++; 6) XD2840N; 7) RU2HR; 8) Q40592; I) (2) confocal optics AL-60 x-stream 600071; and 9) AL-60 x-stream 800012. The Contractor shall provide emergency repair service as required during the hours of 8:00 a.m. ?5:00 p.m., Monday through Friday unless otherwise stated. Labor, travel and replacement parts, as required, excluding consumable items, unless otherwise stated. The maintenance agreement shall include the following over a one-year contract: 1) all replacement parts necessary to keep equipment in proper working order; 2) all replacement parts to maintain the x-stream ; 3) extended warranty of confocal optical system; 4) software support and upgrades; 5) phone and email support needed to assist with software issues; and 6) one (1) preventive maintenance PM service visits plus emergency coverage deemed necessary per system per contract period. The Period of Performance is 10/29/2004 through 10/28/2005. This is not a small business Set-Aside. Rigaku /MSC, Inc. is the sole manufacturer and is the only vendor that can provide compatible parts for these instruments, along with the technical expertise to meet our requirements. Changing vendors could introduce time consuming interruptions to ongoing studies. The North American Industry Classification System (NIACS) code for this acquisition is 811219 and the Small Business Set-Aside is 6.0 million. The FOB will be Destination, to Bethesda, MD, 20892. This will be a firm-fixed price contract. The following Federal Acquisition Regulations provisions and clauses apply to the acquisition: FAR 52.212-1 Instructions to Offerors-Commercial Items; FAR 52.212-3 Offeror Representations and Certifications Commercial Items; FAR 52.212-4 Contractor Terms and Conditions-Commercial Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items; and FAR 52.204-7 Central Contractor Registration (2003). Offerors shall include with their offer a completed copy of provision at FAR 52.212-3 Offerors Representations and Certifications Commercial Items. (B) (1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
