Description
The United States Special Operations Command (USSOCOM), Headquarters Procurement Division intends to negotiate on a sole source basis with FLIR Systems, Inc., (FSI), Boston, 16 Esquire Road, North Billerica, MA 01862, for Repair Services to the Maritime Forward Looking Infrared (MARFLIR) for a five year period, in accordance with FAR Part 15. The basis for the sole source is that obtaining other than FSI's services for repair of the MARFLIR is not possible due to a lack of rights in technical data. As background information, in 2000, the Government competitively awarded contract N00164-00-D-0026 to FSI for MARFLIR. With this competitive selection, MARFLIRs were fielded and installed on NSW MKV craft. As it was a commercial contract, technical data rights (other than Government Purpose Rights) were not obtained. The Government does not have any mechanical and electrical drawings, information on internal software and interface control documents to provide to another company. In addition the MARFLIR is unique to other available FLIRs, and so repair services for other FLIRs differ from what is required for the MARFLIR. Based on this the repair services for the MARFLIR must be obtained from FSI. Responses to this synopsis must be submitted within 30 days of the date of this announcement.
