- This is a combined synopsis/solicitation for commercial items/services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The National Oceanic and Atmospheric Administration, National Fisheries Office for Law Enforcement (OLE) intends to negotiate on a non-competitive basis with Absolute Communications, Limited located in Cambridge, MA for the renewal of the license to support the SmarTRAC Surveillance System and the Vessel Monitoring System for a period of three years. Pursuant to 41 USC 253?(1), Absolute Software, Inc. is the owner and developer of this proprietary software package and related services. Headquarters OLE provides support for all NOAA law enforcement activities at the Silver Spring, MD location and six divisional offices collocated with regional NOAA facilities. In effort to enhance the enforcement capabilities of OLE, two programs have been implemented. The first is the National Vessel Monitoring System (VMS) which provides a satellite tracking and surveillance capability for the enhancement of Fishery Management Plan (FMP) enforcement efforts. The second is an Enforcement Management Information System modernization program which will enhance enforcement information management, case management, information collection, and information sharing. A third program has been added the Headquarters OLE to enhance the information and collaboration between Law Enforcement Offices. This joint enforcement (JEA) program provides database and web services for agencies from twenty-three participating states. Provision 52.21(JAN 2004)2-1 Instructions to Offerors-Commercial applies to this acquisition. Offerors are to include a completed copy of provision 52.212-3 (MAY 2004), Offeror Representations and Certifications-Commercial Items with its offer. Clause 52.212-4 (OCT 2003), Contract Terms and Conditions; Clause 52.212-5 (OCT 2004), Contract Terms and Conditions Required to Implement Statutes or Executive Orders ? Commercial Items, applies to this acquisition The services required are to renew licensing, provide software assurance, technical support, and consultative services for the SmarTRAC Surveillance System and the United States Vessel Monitoring System program. The contractor shall be responsible for Software Installation, maintenance and repair; system configuration, technical service, and NMFS IT support. Vendors who are holders of the proprietary software package are invited to submit an affirmative response. To be considered an affirmative response, vendors must refer to this solicitation and submit written data and documentation which demonstrates their capability to meet the requirements discussed. A determination by the Government not to open the requirement for competition based upon responses to this notice is solely within its discretion. Affirmative responses must be received within days from this synopsis. SEE NOTE 22.
