- Questions and Answers for Solicitation W91RUS-05-R-0002. Q1: What is providing the encryption, STU-III, STE, OMNI or Sectera? A1: The encryption question is going in the wrong direction, this system will not nor will it ever transmit classified data, just data requiring privacy protection as stated in HIPAA regulations. The security details are stated at this web link: http://www.j2corporate.com/corp/twa/page/secureFaxSolutions 128 bit SSL encryption is an integral part of domestic web based internet browsers, it is a DOD recognized and authorized encryption system for use in the above listed situations. No additional encryption is required. Once the fax reaches the vendor it is sent as a standard fax over existing phone lines which is again authorized under HIPAA regulations since interception of this information by other than the intended parties is a Federal crime. The standard description of the information is Sensitive but Unclassified. This system is intended solely for the transmission of patient information for the purposes of obtaining authorizations for clinical treatment not available in the Military treatment facility and for no other purposes. HIPAA compliance by the vendor is the primary consideration and it is the vendors responsibility to maintain their own certification, not the United States Army's. They would be the one subject to civil (vice criminal) penalties should a violation of HIPAA regulations occur. The encryption used by this system is sufficient to safeguard the patients privacy until the data is transmitted to the vendor's secure server, at that point patient privacy becomes the responsibility of the vendor in question. Q2: When is the bid response due back? A2: Proposals are due on 13 January 2005 0800 AM.
