- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. RFP No. N65236-05-R-0531 applies and incorporates provisions and clauses in effect through Federal Acquisition Circular 90-37 and Defense Acquisition Circular 91-10. This procurement is 100% set-aside for small business. The NAICS Code is 517310 and the Size Standard is 1500 employees. The requirement is for a Firm Fixed Price, Indefinite Delivery/Indefinite Quantity type contract. The total estimated value if all option quantities are exercised is $4.9 million. The contractor shall bid a unit price, the unit price shall include the equipment, the shipping expense and one-year manufacturers warranty for all items under this contract. Required Delivery: One USC-60 (Line item 0001) must be delivered to Shaw Air Force Base no later than 14 January 2005 and a second no later than 31 January 2005. All other line items and option quantities if exercised shall be delivered to Shaw Air Force Base within 60 day of order. If the vendor fails to meet the delivery requirements of line item 0001 the government may terminate the contract for default at the contractor's expense. If the offeror fails to meet the delivery requirements of the remaining items, the government may terminate the contract for default and procure items from other sources at the contractor's expense. Inspection and acceptance: Destination. Clause 52.212-5, paragraph (b), is tailored to incorporate the following clauses by reference: 52.203-6, Restrictions on Contractor Sales to the Government; 52.203-10, Price or Fee Adjustment for Illegal or Improper Activity; 52.219-8, Utilization of Small Business Concerns and Small Disadvantaged Concerns; 52.222-26, Equal Opportunity; 52.222-35, Affirmative Action for Special Disabled and Vietnam Era Veterans; 52.222-36, Affirmative Action for Handicapped Workers; 52.222-37, Employment Records on Disabled Veterans and Veterans of the Vietnam Era; 52.225-18, European Union Sanction for End Products; and FIRMR 201-39.5202-3 (tailored to include the fill-ins "regulatory" and "NA" respectively). DFARS clause 252.212-7001 is tailored to incorporate the following clauses by reference: 252.225-7007, Trade Agreements; 252.225-7012, Preferences for Certain Domestic Commodities; 252.225-7027, Limitations on Sales Commissions and Fees (tailored to include the fill-ins of "Japan"); 252.225-7028, Exclusionary Policies and Practices of Foreign Governments; and 252.233-7000, Certifications of Claims and Request for Adjustment or Relief. The Government intends to make a single award to the responsible offeror whose offer is the most advantageous to the government, price and price-related factors considered. Clause 52.212-2, Evaluation-Commercial Items (JAN 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Factor A, Technical Capability and Factor B, Capacity/Schedule Capability are equally important, and significantly more important than Factor C Past Performance. Factor D, Price, although important, is not as important as factors A, B, and C combined. (b) Submission of offers. Submit signed and dated offers to the office specified in this synopsis/solicitation at or before the exact time specified in this synopsis/solicitation. Offers may be submitted on a SF 1449, letterhead stationery, or as otherwise specified in the synopsis/solicitation. As a minimum, offers must show -- (1) The solicitation number; (2) The time specified in the synopsis/solicitation for receipt of offers; (3) The name, address, and telephone number of the offeror; (4) Terms of any express warranty; (5) Price and any discount terms; (See Proposal Organization paragraph which follows) (6) Remit to address, if different than mailing address; (7) A completed copy of the representations and certifications at FAR 52.212-3; (8) Acknowledgment of Synopsis/Solicitation Amendments; (9) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the synopsis/solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the synopsis/solicitation may be excluded from consideration. (10) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the synopsis/solicitation. (11) Capacity - It is estimated that the government shall require a minimum of two (2) each of CLINS 0001, 0002, and 0003 at contract award. Offeror must provide verifiable evidence of their ability to meet the schedule requirements. (12) Past performance information, to include three (3) current and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information). Proposal Organization Proposals shall be submitted in one volume containing four (4) Sections: Section 1, Factor A containing the "Technical Capability Information/Literature," Section 2, Factor B containing "Capacity/Schedule Capability verification to meet schedule," Section 3, Factor C containing the" Past Performance", Section 4, Factor D containing the "Price Proposal". The electronic copies of the proposals shall be submitted under the instructions contained in provision L-349. These are considered official copies and are subject to the language on late proposals, withdrawal of proposals, and proposal revisions contained in the FAR 52.212-1, "Instructions to Offerors??? Commercial Items" provision. NOTE: Failure to submit complete information in the manner above may be considered a "no response" and may result in the exclusion of the proposal from further consideration. SECTION 1--FACTOR A: TECHNICAL CAPABILITY INFORMATION/LITERATURE Offerors are required to provide current product literature that fully describes the capabilities of the proposed systems. The literature shall be sufficient to enable technical personnel to evaluate the documentation and make a sound determination as to whether the proposed systems meet the requirements of the synopsis/solicitation. Failure of any performance requirement shall deem the offeror as not qualified. SECTION 2--FACTOR B: CAPACITY/SCHEDULE CAPABILITY Offeror must provide verifiable evidence of their ability to meet the schedule requirements. This evidence should be in the form of a letter of commitment from the supplier or a letter of commitment of in house capability signed by an officer of the offerors company. Failure to on and capability/schedule requirement shall deem the offeror as not qualified. SECTION 3???-FACTOR C: PAST PERFORMANCE INFORMATION The Government reserves the right to use past performance information obtained from sources other than those identified by the offeror. This past performance information will be used for the evaluation of past performance. The Government does not assume the duty to search for data to cure the problems it finds in the information provided by the Offeror. The burden of providing thorough and complete past performance information remains with the Offeror. In the case of an offeror without a record of relevant past performance or for whom current information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance. SECTION 4--FACTOR D: PRICE PROPOSAL The offer shall consist of the following: ?? Signed and completed solicitation package, including all amendments, representations and certifications ?? Schedule of Prices ?? Delivery Dates/Terms ??? A Price Proposal shall be submitted in accordance with the Schedule set forth in this synopsis/ solicitation. This information shall be submitted under Factor D of the offer. Evaluation of an offeror's price proposal shall be based on total cumulative proposed unit prices for all CLINS, including the information presented in the offer and information available to the Contracting Office from sources deemed appropriate. Offers which are unrealistic in terms of technical or capacity commitments, or unrealistically high or low in terms of price, may be deemed reflective of an inherent lack of technical competence, or indicative of a failure to comprehend the complexity of risks of the proposed work and may be grounds for rejection of the offer. L-349 SUBMISSION OF ELECTRONIC PROPOSALS (a) Offerors shall submit their proposals electronically to SPAWAR Systems Center Charleston under the instructions contained in this provision. Offerors shall submit their signed proposals as "PDF" documents. Electronic copies shall be submitted via the SPAWAR E-Commerce Central (SPAWAR E-CC). Offerors submitting electronic proposals (e-Proposals) shall register in the SPAWAR E-CC and select their own password in order to submit a proposal. Offerors are required to read the "Submitting a Proposal?" web page found in the SPAWAR E-CC. For information about "e-Proposal" submission, please visit the SPAWAR E-CC. The URL for the SPAWAR E-Commerce Central is https://e-commerce.spawar.navy.mil. (b) Each electronic file shall also be clearly marked to show the proposal Section number, solicitation number and offeror's name. E-Proposal files shall not contain classified data. The offeror's e-proposal shall be in accordance with the requirements set forth below: (1) Adobe Acrobat version 4.01 or greater shall be used to create the "PDF" files. Cost Data is to also be provided in Excel format. (2)The proposal submission files may be compressed (zipped) into one, self-extracting file entitled "PROPOSAL.EXE" using WinZip version 6.3 or greater. (3) Cost or Pricing Type Data: All information relating to cost and pricing type data shall be included only in the section of the proposal designated by the Contracting Officer as the Cost Proposal. Under no circumstances shall cost and pricing type data be included elsewhere in the proposal. Paragraph cross-referencing between Cost Proposal paragraphs and technical/management proposal paragraphs is requested to provide clarity. (c) Bids and proposals submitted electronically will be considered "late" unless the bidder or offeror completes the entire transmission of the bid or proposal prior to the due date and time for receipt of bids or proposals. Proposal transmission must be completed by 11:00 AM Eastern Time. This paragraph (c) supplements the submission, modification and withdrawal of bids and proposals coverage in the FAR 52.212-1 "Instructions to Offerors--Commercial Items", NOTE: In addition to the electronic submission, offerors must submit one complete hard copy of the proposal to the address listed below prior to the date and closing time specified for receipt of proposals: The hard copy of the proposal MUST be identical to the electronic file submission.
