Description
This is a combined synopsis/solicitation for commercial items/services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotations are being requested and a written solicitation will not be issued. This solicitation is issued as a Request for Quotation. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-25. This solicitation is Set-Aside for small business. The NAICS code is 541990. The U.S. Equal Employment Opportunity Commission (EEOC) is seeking mediators for its nationwide internal Alternative Dispute Resolution Program (RESOLVE). The RESOLVE Program mediates workplace disputes filed with the program by EEOC employees located in 51 field offices. The Program is administered in Washington, D.C. by a Chief Mediation Officer. CLIN 0001. Mediation Service. Minimum guaranteed quantity 20 each/ mediations for the duration of contract inclusive of option years if exercised and the estimated maximum per year are 40 each/mediations. EEOC is seeking mediation service providers who can provide mediation on a national basis. Task orders will be issued. The EEOC contemplates awarding a Firm-Fixed-Price Indefinite-Delivery-Indefinite-Quantity type contract (IDIQ). Multiple awards may be made. Mediators will use a facilitative model of dispute resolution but will not have decision making authority. Mediators will assist the parties in settling their disputes. The disputes may involve numerous interrelated issues and complex fact patterns. The disputes may also involve equal employment opportunity and labor management issues. Mediator Minimum Qualifications: Mediators shall, at a minimum, meet the qualification standards described in Chapter 3 of the EEOC?s Management Director (MD)-110, Chapter 3, Alternative Dispute Resolution, ? IV. Neutrals, b. Qualifications. That provision provides as follows: Training in ADR Theory and Techniques - Any person who serves as a neutral in an agency?s ADR program must have professional training in whatever dispute resolution techniques the agency utilizes in its program [Mediation, in the case of EEOC.] The Commission will accept as sufficient such training as is generally recognized in the dispute resolution profession. For example, the Interagency Program on Sharing Neutrals administered by the Department of Health and Human Services requires the following: (1) at least 20 hours of basic mediation skills training; (2) at least 3 co-mediations with a qualified mediator or 5 independent mediations and positive evaluations from a qualified trainer/evaluator; and (3) at least two verifiable references from 2 qualified mediators or trainer/evaluators. Knowledge of EEO Law: Any person who serves as a neutral in an agency?s ADR program must be familiar with the following EEO laws and areas: The entire EEO process pursuant to 29 C.F.R. Part 1614, including time frames; the Civil Service Reform Act and the statutes that EEOC enforces (including Title VII of the Civil Rights Act of 1964, as amended, the Rehabilitation Act of 1973, as amended, the Age Discrimination in Employment Act of 1967, as amended, and the Equal Pay Act of 1963, as amended); the theories of discrimination (e.g. disparate treatment, adverse impact, reasonable accommodation); harassment; and remedies, including compensatory damages; costs and attorney?s fees. In addition to the requirements listed in MD-110, mediators shall have a thorough working knowledge of the principles, methods, practices, and techniques associated with mediation. Mediators must describe the training and experience from which they obtained this knowledge. Work To Be Performed: To obtain a mediator, the Chief Mediation Officer, who is located in Washington, D.C., will issue a Task Order/Modification to the Contractor. The mediator shall ensure that a date and time are established and arrangements are made for the location of the mediation. Information regarding the date, time and location of the mediation shall be provided to the Chief Mediation Officer within 5 calendar days of receipt of the request for a mediator. The mediation is to be completed within 45 calendar days of receipt of the mediation file. All mediator travel costs shall be assumed by the mediator. All data supplied to the contractor and all communications between the contractor and EEOC personnel are confidential and will not be disclosed by the contractor to anyone other than RESOLVE Program staff. Period Of Performance: Base year and two, one year options. Technical/Management Proposal: Proposals shall not exceed 10 pages and contain the following information: A description of quoter?s company, including information on how long it has been in existence, the type(s) of services provided, the location(s), number of employees, number of existing contract mediators, contract and other mediation experience and any other relevant information; a brief description of the approach and methodology that you are proposing to accomplish the work and a brief description of your previous experience that is relevant to the requirements. The quoter shall provide a minimum of 3 references for contracts/delivery orders awarded within the past 3 years. The information for each reference shall include the following: name and address of Government agency or other non-Government client; name, title, and telephone number of Contracting Officer, or other point of contact; name, title, and telephone number of client?s Program or Project Manager, if applicable; contract number, period of performance, and dollar value of contract/delivery order and description of services provided. A resume of each person that you are proposing to accomplish the work. Submission of Quotation: Your quotation in response to RFQ No. 050022 are due January 12, 2005, 2:00 p.m. EST. Evaluation factors for award: The Government intends to evaluate quotations and make award(s) without discussions (except clarifications as described in FAR 15.306(a)). Therefore, the quoter?s initial quote should contain the quoter?s best quote. The Government reserves the right to conduct discussions, if the Contracting Officer later determines them to be necessary. The technical evaluation factors are as follows: technical; price and past performance. Technical and past performance are more important than price.
