- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR), Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation Number M68909-05-R-1029 is issued as a request for proposal (RFP). This document and the incorporated provisions and clauses are those in effect through Federal Acquisition Circular 23 and Defense Federal Acquisition Regulations Supplement Change Notice 20050113. The Government intends to purchase using full and open competition, on a firm fixed-price basis and award a purchase order for a quantity of 2 each LEGS Lite System, Part Number VA-022801-9500, and 2 each LEGS Software Update Subscription, Part Number VA-022801-9510. The NAICS is 443120. This requirement will be awarded on or about 15 February ! 2005 with a delivery of 30 days after award. Orders shall be quoted FOB Destination to Commanding Officer, ATTN: Supply Officer, MCTSSA, Building 31345, Camp Pendleton, CA 92055. Inspection and acceptance shall be made at destination. The contractor shall extend to the Government full coverage of any standard commercial warranty normally offered in a similar commercial sale. Acceptance of the warranty does not waive the Government's rights under the Inspection clause, nor does it limit the Government's rights with regard to the other terms and conditions of this contract. In the event of a conflict, the terms and conditions of the contract shall take precedence over the warranty. The warranty period shall begin upon final acceptance of the applicable deliverable listed in the schedule of the contract. FAR 52.212-1 INSTRUCTIONS TO OFFERORS -- COMMERCIAL ITEMS (JAN 2004) is incorporated by reference and applies to this acquisition. The provision at FAR 52.212-2 EVALUATION! -COMMERCIAL ITEMS (JAN 1999) does not apply to this acquisition. The Government will evaluate quotations for lowest price. Offeror shall include a completed copy of the provision at FAR 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS ALT I -- COMMERCIAL (MAY 2004) with its quotation. FAR 52.212-4 CONTRACT TERMS AND CONDITIONS -- COMMERCIAL ITEMS (OCT 2003) is incorporated by reference and applies to this acquisition. The provision at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders?Commercial Items (OCT 2004), Subparagraphs (a); (b) (1), (3), (7), (8), (9), (15), (16), (17), (18), (19), (20), (25), (30); (c); (d); and (e) apply to this acquisition and are hereby incorporated by reference. FAR 52.204-7 Central Contractor Registration (OCT 2003) with DFARS 252.204-7004 ALTERNATE A (NOV 2003) applies to this acquisition. DFARS 252.212-7001 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS APPL! ICABLE TO DEFENSE ACQUISITIONS OF COMMERCIAL ITEMS (SEP 2004), subparagraph (a), clause 52.203-3 is checked; subparagraph (b), clauses 252.225-7001, 252.225-7012, 252.225-7021, 252.243-7002 and 252.247-7023, are checked and applies to this acquisition. DFARS clauses 252.225-7002 Qualifying Country Sources as Subcontrators (APR 2003), 252.225-7002 Trade Agreementes Certificate (JAN 2004) and 252.232-7003 Electronic Submission of Payment Requests (JAN 2004) apply to this acquisition.
