Description
This synopsis/solicitation is being posted to both the Federal Business Opportunities (FBO) page located at http://www.eps.gov and the Navy Electronic Commerce on-Line (NECO) site located at http://www.neco.navy.mil. While it is understood that FBO is the single point of entry for posting of synopsis and solicitations to the Internet, NECO is the alternative in case FBO in unavailable. Please feel free to use either site to access information posted by the Navy Sea Systems Command. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. FAR Subpart 13.5 will be used. The Naval Surface Warfare Center, Dahlgren Division, intends to procure five identical (5) Ship/Submarine Environment and Missile Simulation! (SEMS) racks/equipment and associated hardware. These items are required to complete the SEMS scheduled deliveries to the Naval Undersea Warfare Center. All shall be preassembled and delivered as complete rack systems in accordance with the Statement of Work (SOW). The SOW containing a full description and the delivery date of each appears on the following website: http://www.nswc.navy.mil/wwwDL/XD/SUPPLY/. This solicitation, number N00178-05-R-2016, is a Small Business Set Aside. It is issued as a Request for Proposal (RFP). This solicitation document and incorporated clauses and provisions are those in effect through Federal Acquisition Circulars 2001- 26 (19 JAN 2005) & Class Deviation 2005-o0001, and DFARS Change Notice 20050207. The NAICS Code associated with this procurement is 334111. All offerors must include a completed copy of FAR 52.212-3 Offeror Representations and Certifications - Commercial Items, and DFAR 252.212-7000 Offeror Representations and Certi! fications - Commercial Items, with their quotes. The offeror shall warrant to the buyer, for a period of two (2) years from the date of delivery, that all items delivered under the contract will conform to the requirements hereof, and will be free from defects. In addition, the buyer, at its option, may return to the offeror any nonconforming or defective items or may require correction or replacement of such items. During the first thirty (30) days following the date of delivery the offeror shall be required to correct the damaged or defective item within ten (10) working days. Moreover, all such corrections and/or replacements shall be made within the delivery schedule. For the remainder of the two (2) year warranty period the offeror shall be allotted up to ten (10) weeks to make the necessary corrections. If necessary corrections required at any time within the warranty period are not made within the applicable aforementioned correction time period, the Government w! ill ensure that necessary corrections are made and any costs associated with making these corrections will be borne by the offeror. These terms shall prevail in the event that they conflict with any of the terms of the vendor's standard commercial warranty. The following FAR and DFARS provisions and clauses apply to this acquisition and are incorporated by reference: FAR 52.212-1 Instructions to Offerors - Commercial Items, FAR 52.212-4 Contract Terms and Conditions - Commercial Items, and FAR 52.212-5 Contract Terms and Conditions Required to implement statutes or executive order - Commercial Items (June 2005) (DEVIATION). Finally, DFARS 252.212-7001 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items subparagraphs (a), (b)(252.225-7001), (b)(252.225-7012), (b)(252.227-7015), (b)(252.227-7037), (b)(252.232-7003), (b)(252.243-7002), (b)(252.247-7023), (b)(252.247-7024), (c), and DFARS 252.2! 04-7004 Alternate A, and DFARS 252.209-7001 Disclosure of Ownership or Control by the Government of a Terrorist Country applies to this acquisition. This acquisition will occur via a Firm Fixed-Price (Commercial Hardware) contract. The closing date is 15 March 2005 at 1200 noon, Eastern Standard Time. Anticipated Award date is 22 March 2005. All items shall be priced FOB-Destination, Dahlgren, VA. All items shall be delivered to the NSWCDD Receiving Officer, 17320 Dahlgren Rd, Dahlgren VA 22448-5100, between the hours of 0700 and 1430 local time on weekdays. No deliveries will be accepted on Federal Holidays. Delivery shall be as follows: It is desired that one assembled rack and its associated cable set should be delivered by 15 April 2005 but is required by 25 April 2005. Delivery of the remaining 4 racks with their cables is required by 31 May 2005.
