Description
The National Institute of Standards and Technology (NIST), Acquisition Management Division, on behalf of the Building & Fire Research Laboratory, intends to negotiate on a sole source basis under the authority of FAR 13.106(b)(1), with TA Instruments of New Castle, DE, for an upgrade to an existing Dynamic Mechanical Thermal Analyzer (DMTA). NIST's existing DMTA, the RSA II, has been used for research since 1995. The purchase of the RSA III would allow existing databases to be manipulated and utilized and would also allow the use of five (5) material accessories previously purchased. Sole source determination is based on TA Instruments being the sole manufacturer and provider of the existing equipment, proprietary equipment required for the upgrade, and proprietary software necessary to utilize the equipment. Furthermore, purchase of a different model DMTA would cause NIST to lose access to existing data, and require additional expenditures for accessories to be compatible with a different system. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations, however, responses received by March 15, 2005, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
