Description
This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation is issued as a Request for Proposal . The solicitation document and incorporated provisions, and clauses are those in effect through Federal Acquisition Circular (FAC) 2001-27. The solicitation is 100% set-aside for Small Businesses. The associated NAICS code is 621340 and small business size standard is $5 million. The contractor shall provide Physical Therapy services as needed to the Turtle Mountain Schools (TMS), Belcourt, ND. Period of Performance is April 1, 2005 to December 31, 2005, with four option years (estimated end date 12/31/09). A. GENERAL PURPOSE OF CONTRACT The provision of Professional Evaluations, Consultations and Therapy Services for Exceptional Education students is required under Public Law 105-17, Individuals with Disabilities Education Act (IDEA) of 1997. Physical Therapy Services shall be provided at Bureau of Indian Affairs, TMS, Belcourt, ND. B. PRICING Base 9-Month Term - April 1, 2005 to December 31, 2005 PT _____ per hour PTA _____ per hour; 1st Option Year – January 1, 2006 to December 31, 2006 PT _____ per hour PTA _____ per hour; 2nd Option Year – January 1, 2007 to December 31, 2007 PT _____ per hour PTA _____ per hour; 3rd Option Year – January 1, 2008 to December 31, 2008 PT _____ per hour PTA _____ per hour; and 4th Option Year – January 1, 2009 to December 31, 2009 PT _____ per hour PTA _____ per hour. The number of students could change (increase or decrease) during the course of the school year. The hourly rate is inclusive of all costs: services/labor, supplies/materials, equipment, taxes, per diem and travel (air/lodging/mileage). The Contractor shall not seek third party reimbursement for Physical Therapy Services rendered to TMS. C. STATEMENT OF WORK The Contractor (Certified Physical Therapist [PT] or Physical Therapist Assistant [PTA]) shall provide all necessary certified and/or professionally qualified physical therapy services: manpower, supplies, materials, equipment, and testing materials to perform the work as described below. Services shall occur at Bureau of Indian Affairs, TMS (K-12th). The Contractor shall be required to perform Physical Therapy assessment, treatment, and coordinate services with the TMS staff for special education children and adolescents as needed. Period of Performance - Services will be required during the school year, Monday through Friday. Services may include summer sessions. No services will be required during Federal Holidays, Christmas break (two weeks), and Spring Break (one week). School calendar shows other off days. Scheduling will be confirmed by the COR. Contractor shall: 1. Provide a copy of current State certification for each employee performing under this contract. 2. Be able to practice in the State of North Dakota. 3. Conform to all state and federal regulations, including P.L. 93-112, Section 504, P.L. 94-142, P.L. 98-524, P.L. 99-457, P.L. 101-476, and P.L. 105-17. 4. Perform work and functions in strict accordance with currently approved methods and practices at TMS. The outcome is to insure educational physical therapy services shall be performed and rendered in a competent, efficient satisfactory manner. 5. Provide written documentation to the COR. The documentation remains the property of the TMS. All documentation shall contain all necessary information required to comply with any and all pertinent regulations as mandated by Federal and State laws. TMS shall provide: 1. Space for PT or PTA to provide above-mentioned services. 2. An on site liaison to coordinate services for PT or PTA. 3. Student files and information. Confidentiality – All materials furnished or produced by the Contractor, relating to work performed, researched or derived under this contract, including but not limited to documents, reports and correspondence, will remain confidential. The Contractor shall not release information to any persons, groups of persons, or organization other than the TMS Special Education Program. Breach of confidentiality may be grounds for rescission of the contract. D. CONTRACT ADMINISTRATION Contractor’s Representatives - The Contractor shall notify the Government of a Principal and alternate contact for questions regarding services and contractual matters. The Contractor shall inform the Government, in writing, of any changes to these persons. Contracting Officer’s Representative (COR) - The Contracting Officer will designate a representative in dealing with the Contractor at the site, to administer the technical aspects of the contract and to assure compliance. The representative has no authority to issue change orders or otherwise authorize changes which would affect the contract price, specifications, conditions or period of performance. Designation of a COR will be issued when the contract is awarded. E. NON-PERSONAL HEALTHCARE SERVICES This contract is a non-personal health care services contract, under which the contractor is an independent contractor. The Government may evaluate the quality of professional administrative services provided, but retains no control over the medical, professional aspects of services rendered (e.g., professional judgments, diagnosis for specific medical treatment). The Contractor is required to indemnify the Government for any liability producing act or omission by the contractor, its employees and agents occurring during contract performance. The Contractor shall maintain medical liability insurance, which is not less than the amount normally prevailing within the local community for the medical specialty concerned. F. SUBCONTRACTING The performance under this contract shall not be subcontracted. G.COMPLIANCE WITH PUBLIC LAWS The contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994; the Indian Child Protection and Family Violence Prevention Act, Public Law 101-630; and the Crime Control Act 1990, Public Law 101-647. . By contract performance the Contractor certifies that they will comply with the requirements of the Act. H. BACKGROUND INVESTIGATION In accordance with 25 U.S.C. §3207, Indian Child Protection and Family Violence Prevention Act; 441 DM 5, Personnel Security and Suitability Requirements; 25 CFR, Part 63, Indian Child Protection and Family Violence Prevention, Memorandum dated January 9, 2002 for the Assistant Secretary – Indian Affairs RE: Personnel and Physical Security; all positions with duties and responsibilities involving regular contact with or control over Indian children are subject to a background investigation and determination of suitability for employment. Accordingly, all such positions are required to have a current background investigation conducted by the U.S. Office of Personnel Management in place or on file at the time of contract award. However, an exception may be granted for a period not to exceed six (6) months, to allow a contractor to complete the required background investigation, provided that a Government employee with a current background investigation on file accompany the contractor to all meetings, evaluations, etc. with a student until his/her background investigation is complete. The Contracting Officer will grant this exception, in writing, via a letter delineating the terms and conditions of the exception. If you do not have a current background investigation in place, please contact the BIA Security Office at (505) 248-6359 or 248-6938 and ask to speak to Ms. Jackie Johnson. I. CLAUSES 1452.226-70 Indian Preference. The provision at 52.212-1, Instructions to Offerors –Commercial; 52.212-2 Evaluation – Commercial Items, factors: (i) capability to perform services, (ii) price, (iii) past performance; and the clause at 52.212-4, Contract Terms and Conditions—Commercial Items, apply to this acquisition. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders—Commercial Items, applies to this acquisition and the following additional FAR clauses cited in this clause are applicable: (5) 52.219-6, (7) 52.219-8, (14) 52.222-3, (15) 52.222-19, (16) 52.222-26, (17) 52.222-35 (18) 52.222-36, and (31) 52.232-33. J. Offerors shall submit: 1) Resumes of all employees who will perform under this contract. 2) A statement on company/individual’s capability to perform services. 3) Copy of State Licensure. 4) Copy of Insurance. 5) A completed copy of the provision 52.212-3, Offeror Representations and Certifications—Commercial Items.
