- The Regional Contracting Department, Fleet and Industrial Supply Center (FISC), Pearl Harbor, Hawaii intends to award a sole source, unrestricted contract to Shield Technologies Corporation for the following Envelop Protective Covers. The proposed contract action is for commercial supplies for which the Government intends to solicit and negotiate with only one source under the authority of FAR13.501(a)(1)(ii). Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive quotes. However, the Government will consider all quotes received within fifteen days after date of publication of this synopsis. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to con! duct a competitive procurement. The applicable NAICS Code is 314912 and 500 employees respectively. Award will be conducted under the provisions of FAR Part 12 Commercial Item and FAR Part 13 Simplified Acquisition Procedures. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, Streamline Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; PROPOSALS ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. Reference Request for Quotation (RFQ) number N00604-05-T-0353 on all quotes and correspondence. The Prospective contractor is responsible for monitoring this site for the release of amendments (if any) or other information pertaining to this solicitation. This synopsis/solicitation is being issued as a Request for Quotations (RFQ), for a Firm Fixed Price t! ype contract incorporating provisions and clauses in effect through Federal Acquisition Circular FAC 2001-27, Effective 01 January 2005 & Class Deviation 2004-o0003 current to Defense Change Notice 20050113 Edition. This requirement is for a firm fixed price contract for the following: [CLIN 0001] Envelop covers for MK38 25 mm guns, Part number 113048, quantity of 290 each. [CLIN 0002] Envelop covers for Twin .50 cal guns, Part number 113050, quantity of 300 each. [CLIN 0003] Envelop covers for Single .50 cal guns, Part number 113046, quantity of 276 each. Quotes shall be FOB Destination pricing. The period of performance will be from date of award through 30 September 2005. The contractor will deliver and initially install the products on individual vessels as they become available, to be coordinated directly with Fleet representative verification. A training video and briefing shall be provided with each cover that addresses installation, operation and maintenance ! of the cover. The prospective contractor must be registered in the Central Contractor Registration Database (CCR) to be eligible for Department of Defense Contract awards. Lack of registration in the CCR database will make an offeror/quoter ineligible for award. The provision at FAR 52.212-1, Instructions to Offerors-Commercial Items applies. The Government intends to award a contract without discussions but reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. Unless otherwise provided in the schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered at the unit prices offered unless the offeror specified otherwise in the offer. A single award will be made to the responsible contractor whose proposal is lowest price, technically acceptable. Technical acceptability is more important than ! price. REVIEW OF AGENCY PROTEST (FISCPH) (APR 2000) (a) The contracting activity, Fleet and Industrial Supply Center, Pearl Harbor (FISCPH), will process agency protest in accordance with the requirement! s set forth in FAR 33.103 (d) (4), agency protests may be filed directly with the appropriate Reviewing Authority or a protester may appeal a decision rendered by a Contracting Officer to the Reviewing Authority. (c) The Reviewing Authority for FISCPH is the Director, Regional Contracting Department (Code 200), Fleet and Industrial Supply Center, Pearl Harbor, at 1942 Gaffney Street, Suite 100, Pearl Harbor, HI 96860-4549. Agency procurement protests should clearly identify the initial adjudicating official, i.e, the Contracting Officer or Reviewing Official. (d) The decision of the Contracting Officer will not extend the timeliness requirements of GAO. Therefore, any subsequent protest to GAO must be filed within 10 days of knowledge of initial adverse agency action.
