Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number for this requirement is RMK0E050025 and is issued as a Request for Proposal (RFP). The solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition 2001-18. This requirement is full and open with a NAICS Code of 923110 and the business size maximum is $6.0 million. The performance period for this requirement is one basic year and four-one year options. ITEM DESCRIPTION: BACKGROUND The Bureau of Indian Affairs (BIA), Office of Indian Education Programs (OIEP), Center for School Improvement (CSI) serves as a state education agency (SEA) for 184 schools serving approximately 47,671 students located in 23 states on 63 American Indian reservations. The scope of work calls for professional education consulting services to assist the BIA, OIEP, CSI in implementing General Supervision, dispute resolution responsibilities authorized under the ?Individuals with Disabilities Act? (IDEA) 2004. The purpose of the dispute resolution process is to provide resolution of complaints, mediation requests, resolution session prior to due process hearing and due process hearing requests in accordance with the IDEA 2004 to ensure every student attending BIA funded schools receiving special education services receive a free appropriate public education. PURPOSE: The purpose of this contract is to ensure that the BIA/OIEP meets the legal responsibilities of the ?Individuals with Disabilities Act? (IDEA) 2004 by establishing a formal process for staff to address disputes (complaints, due process hearings, and mediations) in a timely manner. Complaint investigation, mediation, resolution session prior to due process hearing and due process hearings are legal general responsibilities under the ?Individuals with Disabilities Act? (IDEA) 2004. OBJECTIVES: The Contractor will be responsible for the following: 1. Develop a complaint investigation, resolution session prior to due process hearing, due process hearing and mediation process that meets legal requirements of IDEA 2004. 2. Produces results in accurate and legally correct complaint investigation findings, resolution session prior to due process hearing, due process hearing decisions and effective education mediations. 3. Recruit and train contract complaint investigators, due process hearing officers and mediators that will work under the direction and supervision of the BIA/OIEP staff. 4. Develop information materials for school staff and parents and other stakeholders on complaint investigation, resolution session prior to due process hearing, due process hearing officer and mediation procedures. 5. Provide training on complaint investigation, resolution session prior to due process, due process hearing and mediation procedures for BIA/OIEP staff, special education coordinators, school staff, and parents. 6. Arrange travel for complaint investigators, due process hearing officers, and mediators. Reimburse contractors for travel and consultation. 7. Proof and format complaint investigation reports and send drafts to the BIA /OIEP for final approval and delivery to both parties. 8. Send original mediation agreements to the BIA/OIEP for final approval and archiving. 9. Send minutes and decision of due process hearings to the BIA/OIEP for archiving. QUALIFICATIONS OF EXPERT PROVIDER: The contractor must have expert knowledge and educational background in Special Education and IDEA 2004 requirements and regulations. The contractor must be an expert in: Complaint investigation procedures Mediation Due process hearings Resolution session prior to due process hearing Procedural Safeguards Free Appropriate Public Education (FAPE) Least Restrictive Environment (LRE) Individualized Education Program (IEP) Appropriate evaluations Communicating with parents and students The contractor must have a minimum of 20 years experience that includes knowledge of the Bureau of Indian Affairs/Office of Indian Education Programs organizational structure, Tribally Controlled Community Schools Act, (P.L.100-297), the Indian Self-Determination Act (P .L.93-638), in addition to having knowledge of various American Indian community settings. The Contractor must be prepared to travel extensively to geographically isolated schools and communities, and in many cases, over unpaved roads. TIMELINE: The is an IDIQ contract is for a 12 month time period-with 4 one year options, beginning April, 2005. The on-site complaint investigations will take place throughout the year, with specific dates, and locations dependent upon the complaint specifications. Each investigation is an individual case; however, in accordance with the BIA Eligibility Document, each complaint must be responded to and completed within a 60 day time period from the date the complaint is received. The Contractor will ensure that the entire process is completed within this time frame. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical and past performance, when combined, are more important than cost or price. The source selection committee will evaluate the proposals using the above factors stated above. There will be a background check accomplished on the contractor receiving award and any of his/her employees who will have contact with students. Provision 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. An addendum to this provision is applicable, in which the term offeror, whenever it appears, shall be replaced with the term quoter. Quoters are required to submit completed copies of the provisions at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with their quotes along with a DUNS Number. FAR clause 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition and does not include any addenda. FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statures or Executive Orders, Commercial Items, applies to this acquisition. The following clauses within 52.212-5(b) are applicable to this acquisition: 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.232-33. Contractors are required to register in the Central Contractor Registration (CCR) before award can be made. To register in the CCR, contractors must have access to the internet. Department of the Interior Acquisition Regulation (DIAR) 1452.226-70 Indian Preference, DIAR 1452.226-71 Indian Preference Program, DIAR 1452.204-70 Release of Claims are applicable. Pricing will include all charges/fees and taxes in your hourly rate to perform this requirement. Proposals will be submitted in writing and signed by an individual with the authority to bind their respective company.
