- The Corporation for National and Community Service, a wholly owned Government corporation seeks to buy a non-qualified tax-deferred annuity for an employee in settlement of an employment-related claim. The claim is unrelated to personal injury. The Corporation solicits from brokers who will provide no fewer than three price quotes for annuity products payable for life and 240 months certain, with the beneficiary being the daughter of the employee. The employee is a 54 year old (DOB 8/01/50) female, and her state of issue would be Virginia. The annuity will be funded with a single deposit of at least $200,000 on or about April 29, 2005. At the time of award, the broker must advise the Corporation what the monthly payments would have been if the selected product had been funded at $200,000 on March 2, 2005 and state whether any adjustment to the amount of deposit is required to secure the same financial benefit for the employee. The quote should include an explanation of the method the broker will use to determine whether an adjustment of the deposit is required. At the time of award, the broker is required to review the settlement agreement in this matter and notify the Corporation whether any changes are required to the agreement to make it legally sufficient for Internal Revenue Service requirements. At the time of issue of the annuity policy to the Corporation, the company must provide a letter addressed to the Corporation and the employee stating that it has reviewed the agreement and required changes were made or that the agreement as of the date of issue is legally sufficient for IRS requirements. Annuity payments to the employee commence beginning on August 1, 2007. Any proposed insurer must be rated at least A.M. Best A+ or higher, S&P AA+ or higher, or Moodys Aa2 or higher. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued. Award will be made to the bidder providing the best value to the Government considering the ability to provide the required financial and legal information, rating, and amount of monthly payment. The NAICS code for this requirement is 524210. This solicitation document and the incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-02. The provisions at 52.212.1, Instructions to Offerors?Commercial Items, apply to this acquisition. Offeror must include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications?Commercial Items with its bid. The clause 52.212-4, Contract Terms and Conditions Required to Implement Statutes or Executive Orders?Commercial Items applies to this acquisition. The following clauses listed in 52.212-5 (b) and (c) are included by reference: 52.222-21; 52.222-22; 52.222-23; 52.222-41; 52.225-3; and 52.232-34. All bids must be submitted in writing (facsimile acceptable)(fax 202-565-2804), signed by a person authorized to represent the bidder with the Government and sent to the contracting office address in this announcement. All bids accepted for consideration must be submitted by 2:00 pm, EDT, April 15, 2005.
