- The purpose of this modification is to correct and clarify the Department's requirement for consultant services for data analysis on a higher education issue. The intent of the original notice was to disseminate information on a proposed contract action in accordance with FAR 5.101(a)(2). As such, the following additional information, which better satisfies the requirements of FAR 5.207(c), is being made available. In order to assist ED/OCR in its efforts to complete OCR Case No. 06032021 to determine if the State actions in Oklahoma were inconsistent with its obligations under United States v. Fordice, 505 U.S. 717 (1992), the Department requires the services of a consultant to perform a range of services, all central to addressing the above issue, including, but not limited to the following tasks: 1) developing recommendations regarding the findings; 2) consulting with OCR regarding these recommendations; and 3) preparing a written report to the Office for Civil Rights regarding options and strategies for addressing the outcome of the investigation. It is estimated that it will require one consultant approximately 15 days to complete work on the case. The start date is April 25, 2005. As stated in the original notice, the Department intends to contract with Dr. Clifton Conrad. The Department previously contracted with Dr. Conrad for assistance with the resolution of OCR Case No. 06032021. The work under this proposed contract action is a continuation of the work under this same OCR case. As a result of the work under this case, it was determined that the scope of the investigation related to the case needed to be expanded in order to complete the case. It would take substantial duplication of time and money for another entity to be able to become familiar with the facts and history of OCR Case No. 06032021 and to offer similar services that would meet these requirements, and these costs are not expected to be recovered through competition. All responsible sources, however, may submit a response to Rebecca Hucks at Rebecca.Hucks@ed.gov or Estelita Proctor at Estelita.Proctor@ed.gov which, if timely received, will be considered by the agency. The use of Numbered Note 22, which refers to FAR Part 6, in the original notice was incorrect as FAR Part 6 does not apply to simplified acquisition procedures. However, in accordance with FAR 13.104(b), the Contracting Officer has determined that soliciting from a single source is appropriate based on the circumstances of the contract action.
