Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotations are being requested; a written solicitation will not be issued. The simplified acquisition procedures of FAR Part 13 will be used in conjunction with the commercial item procedures in FAR Part 12. The solicitation is being issued as a Request for Quotation (RFQ). The solicitation number is RFQ 246-05-01981. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-27. The North American Industrial Classification Code (NAICS) is 339112 and the business size standard is 500 employees. The VA Medical Center, Durham, NC has a requirement to establish an agreement for the following items to be placed in the facility on a consignment basis. The items include the following St. Jude Medical Seguin Annuloplasty rings or equal Sarp Models: 24; 26; 28; 30; 32; 34; 36; 38E; and 40. The consignment period will be from a date mutually agreed by both parties for a period 12 months with the option to renew the agreement up to 3 additional option years. Offerors will specify the price at which the above items will be sold to the Government should the item be required for use by the Government at any time during the effective period of the agreement. The Government will assume no liability for any items assigned to the Department of Veterans Affairs on a consignment basis until a requirement for the item exists and a delivery order is placed against the agreement. The Government may cancel the agreement at anytime upon a 30-day written notice to the contractor. The ownership of all products will remain the property of the contractor until such time the items are utilized by the Government. Any unopened and unused products will be returned to the contractor at the end of the agreement period. Proposals shall be submitted on Offeror’s letterhead or bid form and shall contain the name, title, and signature of the person authorized to submit proposals on behalf of the contractor and include the information required in provisions 52.212-3, Offeror Representations and Certifications-Commercial Items (Jan 2005). Quotes shall be valid for 30 days from the offer due date. A Consignment Agreement will be established with the offeror who can meet the requirements listed above and is most advantageous to the Government. The Government intends to evaluate the information received and prepare the agreement without further discussions. The following provisions and clauses apply to this solicitation: 52.212-1, Instructions to Offeror-Commercial Items, 52.212-4, Contract Terms and Conditions-Commercial Items, 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, 52.233-2, Service of Protest, 852.233-70, Protest Content, 852.233-71, Alternative Protest Procedure. In accordance with FAR 52.204-7 award will be made only to a contractor/company that is registered in the Central Contractor Registration (CCR). Electronic copies of the referenced provisions and clauses are available on the Internet at www.arnet.gov/far or you may fax a request to 757-728-3132. Quotations and all required information must be received by 4:00 p.m. EST on April 19, 2005 and shall be submitted in writing to Doris Turner, Contracting Office (90C), VA Medical Center, CAS/VISN 6, Building #27, Averill Drive, Hampton, VA 23667. No fax or electronic offers will be accepted. Solicitation number RFQ 246-05-01981 shall be listed on the documents submitted for identification purposes. Only offers prepared in accordance with this solicitation shall be considered.
