Description

The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b) (1), with HKL Technology Inc., of Danbury, CT for the upgrade to an existing HKL Nordlys CCD EBSD Camera System. Sole source determination is based on HKL Technology Inc. being the sole source manufacturer and provider of the existing equipment, the proprietary equipment required for the upgrade, and the proprietary software necessary to utilize the equipment. Furthermore, purchase of a different model Forescatter Detector would cause NIST’s existing projects to lose capability, and may damage the existing NIST property. The North American Industrial Classification System (NAICS) code for this acquisition is 333314, and the size standard is 500 Employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the government will consider responses received by April 29, 2005. A determination by the Government not to compete the acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
