Description
This is a synopsis for commercial items prepared in accordance with the format under Simplified Acquisition Procedures in accordance with FAR Part 13.5, as supplemented with additional information included in this notice. This solicitation document incorporates provisions and clauses that are in effect through the March 2005 Federal Acquisition Regulation revision, which includes the consolidation of all Federal Acquisition Circulars through 2001-27. This acquisition is 100% small business set-aside and the North American Industry Classification System (NAICS) code is 541720 with a small business size standard of $6.0 million. It is the intent of the National Library of Medicine (NLM) to procure professional services on a sole source basis with Joan Mathys, Washington, DC 20008 to continue services currently being provided by the contractor under an existing purchase order number 467-MZ-302338. The contractor will continue to provide a range of copyright and permissions services to the History of Medicine Division (HMD) of the National Library of Medicine, including obtaining permissions from rights holders, preparing required documents for securing permissions, and negotiating license fees and agreements for multimedia material used in the library's exhibition program and Web sites. Joan Mathys has successfully negotiated copyright and licensing agreements for the use of materials by HMD's Exhibition Program and Prints and Photographs Division, as well as other areas of the Library. In doing this work, she has established contacts with rights holders and has customized forms for seeking and tracking permissions for a variety of projects. Ms. Mathys experience working with international copyright issues and fees has been and will continue to be an asset to the Library. She did considerable work, for example, on the "Strange Hells Within the Minds War Made: War and Trauma in the 20th Century" exhibit, which featured several objects from outside of the United States. She has over twelve years of experience, including four working as a contractor with NLM, conducting picture and film research and clearing rights for imagery for major museum exhibitions, Web sites, books, documentaries, and other multimedia projects. The program area has determined that the project requirement is significantly more complex than originally anticipated. Consequently, additional funds, time and effort are needed in order for the contractor to continue this ongoing work. Introducing a new contractor at this point in time would add significant amount of training time and government coordination, and therefore costs to the government. EVALUATION CRITERIA: The technical proposal will receive paramount consideration over price or cost factors. The evaluation will be based, in addition to price, on a written quotation detailing the demonstrated capabilities of the prospective vendor in relation to the needs of the project as set forth in the Statement of Work. Offerors must submit information sufficient to allow NLM to evaluate the following criteria for award. Criterion A: (40 points) Vendor must have 5 years of successful experience determining copyright status, identifying copyright holders, and securing permissions and rights for reproductions (including photographs, film, documents, and graphics) for use in exhibits, online displays, and printed material. Criterion B: (40 points) Vendor must have 5 years of successful experience maintaining databases of contact information for tracking permission sources for materials used on exhibits, online displays, and printed material, and monitoring the expiration of all permissions. Experience should include communication with registrars, collections managers, curators, private collectors, publication firms, photo stock houses, and other sources for permissions. Criterion C: (20 points) Vendor must have experience working on at least two (2) major exhibitions researching and tracking contact information for potential lenders of materials for display. This requirement is for a base year with options for four (4) successive one-year periods. This notice of intent is not a request for competitive quotations however, all responses received, within 15 days from the date of publication of this synopsis will be considered by NLM. The quoter shall include all information which documents and/or supports the qualification criteria in one clearly marked section of its quotation. ** The Statement of Work (SOW) of this requirement is immediately followed below **. The contractor shall comply with all applicable Federal, State, and local laws, executive orders, rules and regulations applicable to its performance under this order. The FAR provisions and clauses sited herein are incorporated by reference into this solicitation. Offerors are advised to propose in accordance with the provision of FAR 52.212 1, Instructions to Offerors Commercial Items. Offerors are advised to provide with their offer a completed copy of the following provisions: FAR 52.212 3, Offeror Representations and Certifications Commercial Items. The following FAR clauses apply to this acquisition: FAR 52.212 4, Contract Terms and Conditions Commercial Items; FAR 52 212 5, Contract Terms and Conditions Required to Implement Statutes or Executive orders Commercial Items. ** Statement of Work Permission and Rights for Use of Multimedia Material For the National Library of Medicine (NLM) Title: Permission and Clearance for Use of Multimedia Material for the National Library of Medicine (NLM) 1. Background: The National Library of Medicine (NLM) owns material documenting cultural and social history, science, medicine, and technology that is used in physical and online exhibitions, online image databases, and educational materials. These resources feature books, journals, photographs, film, manuscripts, and prints from the Library's collections. NLM exhibitions and databases also include artifacts, images, graphics, videos, interviews, original animations, and audio recording from other institutions, which are incorporated into interactive displays and electronic resources. In addition, NLM produces numerous supplemental programs including but not limited to online exhibitions, theatrical presentations, collateral print pieces, catalogues, education packages, documentaries, DVD exhibitions, and other public programs. 2. Objectives: In order to use outside materials, NLM must obtain world rights for use of images and materials in DVDs, promotion, advertising, Web use, distribution and sale of multimedia material. It is necessary to negotiate the use of materials prior to using them in the production of our resources. NLM has need of a company who can trace the ownership of the required items, negotiate the use of the items and pay any required copyright or permission fees. 3. Scope of Work: The vendor shall obtain rights and permissions, prepare required documents, and renew expiring permissions to use and reproduce images and video footage for the use of the NLM programs, including the Exhibition Program, Prints and Photographs Program, Historical Audiovisuals Program, Archives and Modern Manuscripts Program, and Digital Manuscripts Program. The vendor shall obtain permissions for the development of exhibits, online displays, and other supplemental materials such as printed material and DVDs. The vendor shall also obtain identification and contact information of rights holders for materials at NLM for the control of intellectual property assets. 4. Vendor requirements: Research and analysis of ownership of required item. Secures permissions and rights for all reproductions (including photographs, and graphics) for use in exhibits, online displays, and printed material. Vendor will research contact information for potential copyright holders and secure permission and rights for materials as needed and instructed by NLM staff. For display of materials as part of an exhibit, vendor will research contact information for potential lenders to exhibition as needed and instructed by NLM staff. Develops and maintains contacts with registrars, collections managers, curators, private collectors, publication firms, photo stock houses, and other sources for permissions. Maintains a system which tracks permission sources for all materials, and monitors the expiration of all permissions. Keeps permissions current by reminding project officer of all expiring permissions for those with time limitations and renews permissions as required. Vender will consult with NLM staff on all permissions and copyright. 5. Government Responsibilities: NLM will provide detailed orientation and oversight for the project. NLM will provide the contractor with specific items or collections need to be researched. NLM will provide sample agreement documents. NLM will agree to the terms and conditions of all permissions prior to final execution of the agreements. 6. Reporting Requirements and Deliverables: The vendor shall submit quarterly progress reports describing permissions received during that time period. The vendor shall be responsible for reporting problems encountered which may lead to their inability to obtain rights or permissions of needed materials. The vendor will supply invoices based on the permissions researched and obtained. On occasion, the vendor will meet face-to-face with the project officer to provide status reports. 7. Inspection and Acceptance Requirements: The project officer will consult with the vendor during all phases of the activities, reviewing plans prior to implementation, reviewing work for accuracy, and making recommendations as needed to ensure conformation to NLM specifications. 8.
