Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. The United States Army Tank-automotive and Armaments Command ??? Picatinny Arsenal TACOM-Picatinny), Picatinny Center for Contracting and Commerce (PC3) intends to solicit, negotiate and award a Purchase Order for one (1) Nomadics, Fido XT Portable Explosive Dector and Starter Kit with fifty (50) Sensor Elements (glass capillaries with explosive sensing material), and one (1) 1-day on-site orientation and training. In accordance with FAR 11.105, Only the Nomadics Fido XT has the features determined to be essential to the Government's requirements, and market research indicates other companies' similar products, or products lacking the particular feature, do not meet, or can not be modified to meet, the agency's needs within the time period required for award. These requirements include must be a commercially available item requiring no modification for use by the military, weight less than 3 lbs., battery or AC power, and ability to detect most common explosives in all environments. Delivery is required within two (2) weeks of Purchase Order award. Place of delivery will the US Army RDECOM- Picatinny Arsenal, NJ. This represents a first time buy for this item in support of Agency requirements; as such, no history is available. This announcement constitutes the only solicitation; and a written solicitation will not be issued. The solicitation number is W15QKN05-T-0809. The solicitation is issued as a Request for Quote (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-02 and Class Deviation 2005-o00001. This acquisition is 100% set-aside for Small Business. The requirements will be fulfilled using the Simplified Acquisition procedures, Part 13 of the FAR, and the test program authorized in FAR subpart 13.5, to the maximum extent possible. The associated North American Classification System (NAICS) code is 334516 and the FSC is 6640. The small business size standard is 500 employees or less. Offerors may be authorized dealers or resellers of the product that they are offering to the Government. The provision at 52.212.2, Evaluation ???Commercial Items, will be used to evaluate offerors for awarding a Purchase Order. The Government intends to award from this solicitation to the lowest price responsible offeror proposing the brand name indicated above. The following factors shall be used to evaluate offers: (1) Price and (2) Delivery. Factor 1 is more important than Factor 2. Offerors must include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications???Commercial Items, with its offer. The clause at 52.212-4, Contract Terms and Conditions???Commercial Items, applies to this acquisition. The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders???Commercial Items, applies to this acquisition: 52.203-6, Restrictions on Subcontractor Sales to the Government (Jul 1995), with Alternate I, 52.219-6. Offerors shall submit two (2) copies of their electronic proposals on CD-ROM, to the US Army TACOM- Picatinny, Picatinny Center for Contracting and Commerce, AMSTA-AQ-APH, ATTN: James Turner, Bldg. 9, Picatinny Arsenal, New Jersey 07806-5000 closing date for receipt of proposals is 3:00 p.m. EST, 26 MAY 05. Important Note on Foreign Content: The Defense appropriations and authorization acts and other statutes (including what is commonly referred to as ???The Berry Amendment??? imposes restrictions on the DOD???s acquisition of foreign products and services. Generally, Clothing and Textile items (as defined in DFARS clause 252.225-7012) and ???specialty metals??? (as defined in DFARS clause 252.225-7014) must be grown, reprocessed, reused, melted or produced in the United States, its possessions or Puerto Rico, unless one of the DFARS 225.7002-2 exceptions applies.
