- The U.S. Department of Education (ED), Office for Civil Rights (OCR), Philadelphia Office (Office), has determined that it is necessary to initiate a service contract to employ a consultant to assist the Office in its efforts to determine if the State of Maryland has satisfied its obligations under United States v. Fordice, 505 U.S. 717 (1992) and the current agreement with OCR dated December 2000. ED intends to issue a purchase order on a sole source basis to Dr. Larry L. Leslie, 232 Bond Crayon Road, Tumacacori, AZ 85640-0041. Dr. Leslie has considerable experience and expertise in higher education desegregation matters. He has experience in several major civil rights case involving higher education desegregation cases, which includes the states of Alabama, Mississippi, Texas, and Maryland. The Office for Civil Rights has used Dr. Leslie for similar analysis for the Texas Higher Education System and the Maryland Higher Education System regarding finance in higher education. During the development of the current Maryland agreement, Dr. Leslie has supplied invaluable expertise in a wide range of services, all central to addressing the issue of whether there are remnants of the former de jure segregated system of higher education in the area of the allocation of funding resources pursuant to the current agreement with OCR regarding Maryland's HBCUs, Bowie State University, Coppin State College, University of Maryland Eastern Shore, and Morgan State University and it's traditionally white institutions, including but not limited to, University of Maryland College Park, University of Maryland Baltimore County, University of Maryland Baltimore, University of Baltimore, Towson University, Salisbury State University and Frostburg State University. Given the unique qualifications required and immediate need for the service, Dr. Larry Leslie, services are required to provide the consultative services needed on the issue of the allocation of funding resources as it relates to a determination of whether there are vestiges of the de jure segregated system of higher education in Maryland. It is determined that only one source is reasonably available for this effort. Sole Source authority FAR 13.106-1 is applicable. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact on or before the response due date. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. No contract award will be made on the basis of responses received; however, this information will be used in ED's assessment of capable sources. If an acceptable response is not received by response due date, ED will initiate negotiations with Dr. Leslie. All responsible sources may submit an offer which shall be considered by the agency.
