- NAICS Code: 541620 The United States Environmental Protection Agency (US EPA) intends to issue a modification to contract 68-W-02-035 with Syracuse Environmental Research Associates (SERA), Inc to increase the scope of the contract approximately $400,000 in accordance with 41 U.S.C. 253(c)(2), and FAR 6.302-2 (Unusual and Compelling Urgency). The contract 68-W-02-035 entitled "Probabilistic Risk Assessments for the Environmental Fate and Effects Division" was awarded competitively to the Syracuse Environmental Research Associates, Inc. (SERA) in May 2002 as a small business set-aside. With the enactment of the Pesticide Registration Improvement Act (PRIA) in 2003, the time frame for the contractor to complete the risk assessments became significantly accelerated. In order to adjust the schedules and complete registration and reregistration risk assessments at such an accelerated rate, additional contractual support was needed to perform the requirements. The burden of meeting the accelerated timeframes was absorbed by the level of effort already included in the contract, however the level of effort was consumed far more quickly than the original periods of performance would indicate. Additionally, it is now estimated that the capacity of this contract will be exhausted during the first quarter of fiscal year 2006. This effectively shortened the life of the contract by 1-1? years. Given current procurement legislation, practice, and procedures, award of a competitive follow-on contract cannot be completed until approximately the second quarter of fiscal year 2006. The purpose of this increase in scope is to provide uninterrupted contractor support until the award of a competitive follow-on contract. These circumstances are both unusual in that they arise from passage of legislation after contract award and compelling in that the Agency is subject to adverse litigation and penalties if it should fail in its obligations under PRIA. Failure to issue this sole source modification will result in unacceptable delays to the completion date of risk assessments set by the Agency. Most of these actions are subject to the decision review periods in accordance with PRIA legislation. If EFED does not complete these risk assessments by the due dates set by the Agency, the registrant can seek judicial review against EPA. Delay in issuance of this sole-source modification will result in serious injury to the Government in the form of adverse litigation and penalties.
