Description
NOAA FISHERIES HAS A REQUIREMENT TO DEVELOP SALMON AND STEELHEAD RECOVERY PLANS WHICH WILL ADDRESS THE RECOVERY OF THE SPECIFIED LISTED SPECIES IN GENERAL AND ON TRIBAL LANDS IN USUAL AND ACCUSTOMED FISHING AREAS (U&AS). BASED ON 1855 TREATIES BETWEEN THE UNITED STATES AND THE CONFEDERATED TRIBES OF THE UMATILLA INDIAN RESERVATION, COLUMBIA RIVER INTER-TRIBAL FISH COMMISSION MEMBER TRIBES, THE CONFEDERATED TRIBES OF THE WARM SPRINGS RESERVATION OF OREGON, THE NEZ PERCE TRIBE, AND THE CONFEDERATED TRIBES AND BANDS OF THE YAKAMA INDIAN NATION, THE TREATY OF NEAH BAY WITH THE MAKAH TRIB, AND THE COLVILLE CONFEDERATED TRIBES? RESPONSIBILITIES AS CO-MANAGER OF THE SALMON AND STEELHEAD THAT ARE THE SUBJECT OF NOAA FISHERIES? RECOVERY EFFORTS, NOAA BELIEVES THESE TRIBAL ENTITIES ARE THE ONLY SOURCE FOR INFORMATION AND ANALYSES AS THEY RELATE TO INDIAN LANDS AND U&A?S. ADDITIONALLY, NOAA BELIEVES THAT THE NORTHWEST INDIAN FISHERIES COMMISSION, A TRIBAL ORGANIZATION ESTABLISHED BY THE TREATY INDIAN TRIBES TO PROVIDE COORDINATION AND TECHNICAL SUPPORT ON TRIBAL FISHING ISSUES IN WASHINGTON STATE, IS THE ONLY SOURCE FOR ASSISTANCE IN PREPARATION OF AN ENVIRONMENTAL IMPACT STATEMENT ON PUGET SOUND SALMON HATCHERIES, SINCE THEY ARE THEY SOLE ORGANIZATION TO REPRESENT THE TRIBES ON THE TRIBAL SALMON HATCHERY ISSUES THAT ARE EXPECTED TO ARISE IN DEVELOPMENT OF THE EIS. THESE PROCUREMENTS WILL ALSO FULFILL THE GOVERNMENT?S TRUST RESPONSIBILITIES (EXECUTIVE ORDER 13175) TO ENGAGE INDIAN TRIBES ON ACTIONS THAT HAVE IMPLICATIONS ON TRIBAL RESOURCES. THESE PROPOSED SIMPLIFIED ACQUISITION ACTIONS ARE FOR SERVICES FOR WHICH THE GOVERNMENT INTENDS TO SOLICIT AND NEGOTIATE ONLY WITH THE NAMED TRIBAL ENTITIES. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS; ANY INFORMATION SUBMITTED BY PARTIES SHOWING CAPABILITY TO ACCESS TRIBAL LANDS AND DATA, AND PROVIDE INFORMATION AND ANALYSES REGARDING SPECIES STATUS AND FACTORS OF DECLINE/LIMITING FACTORS BE CONSIDERED SOLELY FOR THE PURPOSE OF DETERMINING WHETHER TO CONDUCT COMPETITIVE PROCUREMENTS.
