Description

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Request for Quotation (RFQ) E001099 is assigned and shall be referenced on question. All incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-05. The North American Industry Classification System (NAICS) code is 541519 with a business standard of $21.0 million dollars. The solicitation will be distributed soley through the General Services Administration?s Federal Business Opportunities web site http://fedbizopps.gov. The site provides downloading instructions. All future information about this acquisition including solicitation amendments, will also be distributed solely through this site. Interested parties are responsible for monitoring this site to ensure that they have the most up-to-date information about this acquisition. This contract action will result in a Firm Fixed Price One Time Buy contract. The government intends to procure on a sole source basis for continuing software support for Etherpeek software from Wildpackets, Inc., Walnut Creek, CA 94596. Wildpackets, Inc., is the manufacturer of the Etherpeek software. The proposed contract action is for software support for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1. Interested persons may identify their interest and capability to respond to the requirement. FOB Destination, FBI, ERF Bldg., #27958A, Quantico, VA. This is not a request for competitive quotes, however, all compliant quotes received within fifteen (15) days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed acquisition based upon responses to this notice is soley within the discretion of the Government. Information received from other than the requested party will be considered solely for the purpose of determining whether to conduct a competitive procurement. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1 Instructions to Offeror-Commercial Items (JAN 2005); FAR 52.212-2 Evaluation -Commercial Item (JAN 1999); FAR 52.212-3 Offeror Representations and Certifications-Commercial Items (JAN 2005); FAR 52.212-4 Contract Terms and Conditions-Commercial Item (OCT 2003); FAR 52.212-5 Contract Terms and Conditions-required to Implement Statutes or Executive Orders (JULY 2005). Each offeror shall include a completed copy of the FAR provision 52.212-3 Offeror Representations Certifications-Commercial Item (JAN 2005); PROTEST AFTER AWARD (Aug 1996). Any quotes not received by the designated time and date will not be accepted. An award is anticipated within one (1) week after closing.
