Description
NAICS Code: 541990 Under the authority of FAR 13.106-1(b), the U.S. Environmental Protection Agency intends to negotiate on a sole source basis with MacDonald Environmental Sciences Limited (MESL) to provide technical assistance for the ecological risk assessment, field oversight, and review of Federal Court directed deliverables associated with the Anniston PCBs Site. PCBs were produced at the former Monsanto plant (Facility) in Anniston, Alabama from 1929 through 1971. Solutia Inc., the present Facility owner, was created in 1997 as a spin-off of Monsanto. The U.S. EPA's Environmental Response Team (ERT) has been sampling this site since 1999 and has found that PCBs have migrated away from the Facility as a result of surface water transport. Solutia began sampling residential properties as specified in an agreement with EPA (the Time- Critical Removal Order) in May of 2001. A Partial Consent Decree (PCD) for the Site was entered by the United States District Court for the Northern District of Alabama on August 4, 2003. The Partial Consent Decree requires Solutia to continue work under the Time Critical Removal Order and begin a Non-Time Critical Removal (NTC) and a Remedial Investigation and Feasibility Study (RI/FS). The NTC Removal Action is being used at the Anniston PCB Site to achieve immediate risk reduction on residential properties not addressed by the Time Critical Removal Order while the RI/FS is completed and the final remedy is selected. Within the PCD, the Court has outlined a schedule of the investigation and deliverables. MESL has been providing technical and policy support to ERT in their oversight of the RI/FS investigation for the PCD. Through these activities MESL has gained a unique historical knowledge and understanding of the site. This knowledge and understanding is critical to enable EPA to respond within the court imposed deadlines contained in the PCD. Continuity of staffing is also necessary to maintain consistency and the confidence of the Court and the Court appointed Special Masters. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This procurement will be accomplished under FAR Part 12, Commercial Acquisition Procedures. Interested parties may identify their interest and capability and respond. Documentation must be received by August 25, 2005 in order to be considered by the EPA. A determination by the Government not to compete this proposed contract based upon assessment of responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested parties should submit a written response to Matthew J.
