Description
This is a combined/solicitation notice of intent for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are not being requested and a written solicitation will not be issued. The solicitation number for this acquisition is NOI-5109 and the solicitation is being issued as a notice of intent. This solicitation document and its incorporated provisions are those in effect through the Federal Acquisition Circular (FAC 2005-05). The National Institute of Allergy and Infectious Disease (NIAID) intends to procure an order for reagents from BD Biosciences to continue testing of reagents for vaccine clinical trails (NIAID Project #: Z01-AI-005009). The anticipated period of performance is from 09/14/05 thru 09/31/06. The Contractor will utilize shipments of custom IFN-g PE Clone (90 each), IL-2 PE Clone (90 each), CD4 Percp (157 each), CD3 APC (19 each), and CD8 (SK1) FITC (78 each) clinical reagents for the research vaccine development. Extensive testing and optimization was conducted at the onset of the clinical trail monitoring, these reagents from BD Biosciences was tested along with other reagents from other vendors. The primary goal is to maintain the consistency of the data; therefore the reagents must stay the same. It is necessary for each reagent to be of the same lot number in order to last through the entire phase of the study. BD Biosciences has been identified as the only responsible source for this procurement. Switching to another manufacturer would result in significant time delays, additional cost to the government to complete redo the optimization process of the clinical trails. This is not a Small-Business Set Aside. The North American Industry Classification System (NIACS) Code for this acquisition is 325413, SIC Code 2835, and the small-business size standard is $11.5 million dollars. This is a firm fixed-price contract and the FOB terms are ?Origin? and Net 30. These items are to be shipped in specified quantities at the end-user?s request. FAR provisions and clauses that apply to this acquisition: FAR 52.212-1, Instructions to Offerors, Commercial Items; FAR 52.212-3, Contractor Terms and Conditions, Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders, Commercial Items; FAR 52.225-3, Buy American Act; FAR 52.204-7, Central Contractor Registration; and FAR 32.703-2, Availability of Funds. In order to be considered for an award, an offeror must have completed the online electronic Representations and Certifications located at http://orca.bpn.gov/ in accordance with FAR 4.1201(a). By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR at www.ccr.gov/ prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation [Note: Lack of registration in the Central Contractor Registration will make an offeror ineligible for award.] Offers must be submitted no later than 5:00 P.M.
