Description

21 CONS/LGCBA intends to make an award using Simplified Acquisition Procedures (SAP) under FAR Part 12, Commercial Items, to Miteq Inc. Under this proposed action, 21 CONS/LGCBA will procure three Miteq VM100R analog modulators . The NAICS for this requirement is 334220. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source is under the authority of FAR 13.106-1(b), ?Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization)?. Exception to Justification & Authority (J&A) requirement, FAR Part 6.001 reads, ?This part applies to all acquisitions except -- (a) Contracts awarded using the simplified acquisition procedures of Part 13. Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals; however, all proposals received by 2:00 P.M. Mountain Time on 7 Sep 2005 will be considered. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
