Description
The US Coast Guard intends to issue a purchase order for the refurbishment of Hub Assemblies to Sikorsky Aircraft Corporation as the only known source of supply. However, all responsible offeror will be considered. Provide pricing and delivery for 1 each, Hub Assembly, NSN 1615-01-158-9589, P/N 70103-28012-041 and 1 each Hub Assembly, NSN 1615-01-HS1-4524, P/N 70070-10046-057. The Hub Assemblies are utilized on the USCG fleet of HH-60J aircraft. Contract award will be made utilizing Simplified Acquisition Procedures. Solicitation number HSCG38-05-Q-S00079 is issued as a Request for Quote. This solicitation document incorporates provisions and clauses in effect through FAR Circular 2005-05. This is an unrestricted solicitation. Award will be made to the offeror meeting technical acceptability and offering the lowest price. Prices are to be firm fixed price. Delivery of all items should be within 90 days after receipt of order. The following provisions and clauses are incorporated by reference: FAR 52.212-1 Instructions to Offerors-Commercial Items (Jan 2005) with the following included by Addendum: 52.211-14 Notice of Priority Rating for National Defense Use (Sept 1990) DO rated; FAR 52.212-2 EVALUATION - COMMERCIAL ITEMS (JAN 1999) (a) The Government will award a contract(s) resulting from this solicitation to the responsible offeror(s) whose offer, conforming to the solicitation, will be most advantageous to the Government. Offers that are significantly higher or lower than the government?s estimate may be considered an indication that the offeror does not understand the requirement and may be evaluated as posing a significant performance risk. Performance risk will be integral to the evaluation of all proposals. FAR 52.212-3 Offeror Representations and Certifications- Commercial Items (May 2004)-This requires offerors to provide representations and certifications electronically via the BPN website; http://www.bpn.gov. Representations and Certifications must be updated annually, for accuracy and completeness or to make changes that affect only one solicitation by completing the appropriate sections of either paragraph (j) of FAR provision 52.212-3(Jan 2005). This change represents a conversion of a paper-based process to a more efficient electronic process of obtaining the offeror?s representations and certifications. Drawings or specifications are not available, and cannot be furnished by the Government. Packaging, packing, and preservation shall be in accordance with best commercial practices to enable shipment to destination and transshipment to Coast Guard units without repackaging or incurring damage during shipment and handling. Packaging material shall not consist of the following: popcorn, shredded paper, Styrofoam of any type, or peanut packaging Items shall be individually packaged and labeled. Labeling shall include the appropriate National Stock Number, Part Number, Nomenclature, Quantity, Contract Number and Line Item Number. Labeling data shall be attached to the outside of the shipping container. Bar coding is not required. The contractor shall furnish a Certificate of Conformance in accordance with Federal Acquisition Regulation (FAR) clause 52.246-15. Certificate of Conformance must be submitted in the format specified in the clause The Defense Priorities and Allocations System assigned rating is DO-A1. Closing date/time for submission of quotations is 08 Sep 2005 at 9:00 A.M. local time. All responsible sources may submit an offer, which will be considered. Offers may be submitted on company letterhead stationery indicating the National Stock Number, Nomenclature, Part Number and Unit Price and FOB point. The government reserves the right to order in whole or in part. Multiple awards may result from this solicitation. NOTICE FOR FILING AGENCY PROTESTS. It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as a Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forums Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman. Informal forum with the Ombudsman. Interested parties who believe that Coast Guard procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the Coast Guard Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester?s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency?s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103(d)(2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude refilling of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103 (e).
