- The Department of Veteran Affairs Network 22 Logistics Office intends to procure certified court reporter services on as needed 24-hour notice basis. Complete accuracy in recording (legal shorthand by machine) and transcribing proceedings is required and expected. Accuracy will be determined by input from deponents upon review of transcripts for certification. In the event a deponent must be re-interviewed due to grossly inaccurate recording and transcription, that interview will be recorded and transcribed at no charge to VA Loma Linda Healthcare System. More than three instances during a fiscal year of re-interview necessity will cancel this contract with the Contractor and the contract will be re-let for bids. If at any time a court reporter provided is not deemed capable to perform the service by the Chair of the proceeding, the VA Loma Linda Healthcare System has the right to stop proceedings, notify the Contractor that the reporter assigned is not performing as needed, and request a replacement court reporter at no additional cost. If at any time a court reporter fails to appear as scheduled, Contractor is to provide a replacement at the earliest time. Contractor may be held liable for charges incurred by VA Loma Linda Healthcare System for delaying scheduled deposition(s) in such cases. Charges may include but are not limited to, travel for Board members and/or deponents; and/or per diem for Board members and/or deponents. In the alternative, such failure as discussed in this section, charges for wait time may be calculated at the rate per hour equal to the hourly rate charged by Contractor for court reporter services. Three such instances of failure to appear as scheduled during any fiscal year will cancel this contract with the Contractor and the contract will be re-let for bids. In the interim until a new contract is awarded, the VA Loma Linda Healthcare System may use certified court reporter services from non-contract providers. Court reporters assigned to service the contract are expected to notify the Chair of the proceedings of any conditions that prevent accurate recording of depositions. If the Chair does not respond to that notification and rectify the problem, the court reporter is to notify the Contractor who in turn will notify the contracting officer or the Executive Office of VA Loma Linda Healthcare System of the situation and condition. In no event is the court reporter expected to withstand verbal and/or physical abuse in performing the duties or provide service in an unsafe environment. Product to be provided: one certified transcript, one condensed transcript, one concordance and transcript in ASCII disc(s) for each deponent. In the event the same person is deposed on separate dates within a calendar week, the transcript will include all depositions for that period in one document properly identified as to dates and times except in cases where the Chair of the proceedings requests separate transcripts. Transcripts to be unbound with attestation signature page for deponent and, original signed and dated certification page of court reporter. Product may be provided by e-mail using industry accepted encryption software such as Real Legal E-transcript however, an original signed and dated certification statement must be provided by the court reporter for each deponent transcript and this must be provided within 24 hours of sending product by e-mail. Contractor to provide at no cost the decoding software to receive and print product from e-mail transmission and save product in ASCII format to disc. VA Loma Linda Healthcare System will not pay for all or any part of any software used by the Contractor to provide the service covered by this contract. In the event that VA Loma Linda Healthcare System does pay for all or any part of any software used by the Contractor to provide the service covered by this contract, the Contractor is barred from using that software for any other contract or service to any party except VA Loma Linda Healthcare System. Transcript turnaround charges: transcripts are to be provided under the general conditions of this contract within 10 days (including weekends and holidays). Premiums for less than the general condition are to be clearly transmitted to any requesting party for less than the general condition of within 10 days for receipt of transcript. All turnaround periods include weekends and holidays. In no event will a premium be charged or paid for product received before the general condition of within 10 days or for any special timeframe requested than the charge for the timeframe requested. Delivery charges for product will not be added to any invoicing. Invoicing to clearly state charges for certified court reporter and charges for transcript product.
