- NASA/MSFC has a requirement for the conversion MSFC's existing Digiray X-Ray Laminography System into a state-of-the-art 64 sensor Motionless Laminography X-Ray System. NASA/MSFC intends to purchase the items from Digiray Corporation, 317 Hartford Rd, Danville, CA. This recommendation is made pursuant to FAR 6.302-1, which implements the authority for 10 U.S.C. 2304(c)(1) for acquisition of supplies or services from only one source and no other supplies or services will satisfy agency requirements. Competition is impractical for the following reasons: 1. Digiray manufactured the X-Ray source. It is unique in that the X-Ray beam scans across the face of the tube and is synchronized with the acquisition of data from the detectors. The upgrade to the system requires proprietary information about the operation of the X-Ray scanning source. Only Digiray Corporation has this information regarding the X-Ray source. 2. Digiray has active patents that cover the Digital Laminography, the Pan and Zoom on the system, auto matching and auto finding of the sensors, and source gradient removal. The first patent is on the basic process of the X-Ray source moving with stationary sensors and processing to generate slices through the part being inspected. The second patent concerns image processing of the slices and images. The remaining patents concern the calibration of the sensors and X-Ray source. These patents prevent other firms from building a similar system. 3. Digiray is the only known source that can fulfill the Government's requirements. The Government intends to acquire a commercial item using FAR Part 12. Access board standards located at url: http://www.section508.gov/index.cfm?FuseAction=Content&ID=12 necessary to ensure compliance with Section 508 of the Rehabilitation Act of 1973 applicable to this acquisition are Section 1194.21 and 1194.26. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on September 09, 2005. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the agency. An Ombudsman has been appointed.
