- DESCRIPTION: The National Institute of Standards and Technology (NIST) Acquisition Management Division intends to negotiate on a sole source basis under the authority of Section 4202 of the Clinger-Cohen Act of 1996 with ABAQUS East LLC, 300 Centerville Road, Suite 209W, Warwick, RI 028860201, for the renewal of software license services. The ABAQUS software license renewal is required to support the existing ABAQUS software program for purposes of uniformity, continuity of services, and cost control. Software license renewal services may only be obtained directly from ABAQUS East LLC, which possesses proprietary rights to the software and software license renewals services. The Government is unaware that any other source that can provide the required ABAQUS software license renewal services. Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. NIST intends to issue a Firm-Fixed-Price purchase order to ABAQUS East LLC for this upgrade unless other sources are identified before response date to this posting. The period of performance shall be September 22, 2005 through September 21, 2006. The list of contract line item numbers (CLIN), their descriptions, the related quantity of each, and the unit of measure for the upgrade are as follows: CLIN 0001, 10 Analysis Tokens, Allow both Standard/Explicit (two analysis job at a time) and access to ABAQUS Aqua and ABAQUS Design; Quantity: 10; Unit of Measure, YR; CLIN 0002, Seats of ABAQUS/CAE, Pre/Post Processing. 1st seat included at no charge. Quantity: 1; Unit of Measure, YR; (CLIN 0001) CLIN 0003, Self-Installation Kit/Media Fee, One time Fee at license inception, Quantity: 1; Unit of Measure, YR. This notice of intent is not a request for quotation; no solicitation is available, however, any interested party believes it can meet the requirements may submit written notification to the Contracting Officer of their interest and bona fide capability to fulfill the requirements. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements listed. Such information will be reviewed to determine if it is necessary to conduct a competitive procurement. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
