Description

AMC Contracting Flight intends to solicit and award a brand name firm-fixed price contract, under Federal Acquisition Regulation (FAR) Part 12. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a quotation is being requested and a separate written request for quotation will not be issued. The North American Industry Classification System (NAICS) for this acquisition is 541330 with a Small Business Size Standard of $23,000,000. Please identify your business size in your response based upon this standard. This is a Brand Name Competition Requirement. The solicitation number for this announcement is FA4452-05-Q-A480. This requirement is for brand name: Baringa 4c Test Set (Qty 3) with Illuminator (BAIL) and Data Acquisition Unit (DAU) to be exchanged for Baringa 5 (Qty 2) Test Sets. Delivery date is 28 September 2005. The invoice be received and accepted by the Government before 30 September 2005 after receipt of order at Robins AFB, GA 31098-1607 on an FOB Destination basis. The Government reserves the right to cancel this solicitation, with no obligation to the offeror by the Government. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. CONTRACTING ACTIVITY. AMC Contracting Flight, Scott AFB, IL 62225-5318. 2. RESERVED 3. DESCRIPTION OF SUPPLIES AND SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS. Air Force Special Operations Command ECSF requires the purchase of three Baringa 4c Test Set with BAIL (Ancillary Illuminator) and Data Acquisition Units (DAU) manufactured only by ESL Defence Limited, 16-17 Compass Pointe, Ensign Way, Hamble, South Hampton, SO31 4RA. Two of the, currently owned Baringa 5 Illuminators, will be exchanged for the upgraded Baringa 4c Illuminators. The upgraded Baringa 4c Illuminators and an additional Baringa 4c illuminator, for a total of three Illuminators, shall be sent to Robbins AFB, GA. 4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. 10 USC 2304 (C)(1) and FAR 6.302-1(a)(ii)(A), Only one responsible source. 5. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATION OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE ONLY ONE RESPONSIBLE SOURCE AUTHORITY. The Government currently has several Baringa Test Sets. ESL Defence is the designer, manufacturer and holds the patented, proprietary engineering information for the Test Set Software. 6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICLE. A combined synopsis/solicitation will be used in accordance with FAR 5.203(a)(2) and 12.603. 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE. ESL has indicated that AAI Corporation and Northup Grumman are the only other distributors for this product. Price reasonableness can be determined by comparison with commercial price lists of this product. 8. DESCRIPTION OF THE MARKET SURVEY CONDUCTED AND THE RESULTS. ESL defence limited has been purchased by the AAI Corporation but no contracts for this particular product has been awarded to AAI to date. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION. 10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION. None. 11.
