- The Federal Bureau of Prisons , Field Acquisition Office in Grand Prairie, Texas, in accordance with FAR 6.303-1, intends to solicit and negotiate a sole source procurement with Opus Healthcare Solutions, Inc., 12301 Research Blvd., Bldg. IV, Suite 200, Austin, Texas 78759. This requirement is to upgrade the existing Laboratory Information System at the Federal Medical Center Carswell (FMC), ?J? Street Building 3000, Fort Worth, Texas 76127. This is a sole source, combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 and Subpart 13.5 as well as supplemental information provided herein. This announcement constitutes the only solicitation and the Government does not intend to issue a written solicitation. This solicitation is being issued as a Request for Quotation . This will be a firm fixed price contract. The BOP will be awarding a contract in accordance with the provisions of FAR Subpart 13.5. Award will be based on best price to the Government. The RFQ incorporates the following provisions and clauses that are in effect through Federal Acquisition Circular 2005-05. FAR Clause 52.212-1 Instructions to Offerors?Commercial Items (JAN 2005), subsection (a), (b), (c), (f), (g), (j), and (k) applies. GENERAL REQUIREMENTS: The laboratory information system will be used for ordering, accessing via internet, maintain compatibility with other BOP patient databases for sharing between data repository environment, translation of the current BOP custom database definitions and all clinical data, historical, current, utilize current patient report structures compatible with historical data and maintaining patient test reports. The laboratory information system will have the capability to process, transmit laboratory final reports and track laboratory work for FMC Carswell and other Bureau of Prison Medical Institutions. Opus Healthcare Solutions, Inc. is the developer and has proprietary rights to the software for the existing Lab Information System at the Federal Medical Center and other BOP Medical Institutions. Order entry, and inquiry into test status by patient name, identification number, accession number. This inquiry shall allow a search for a specified date range, department, test codes, or all tests On line entering and editing of patient demographic date and test requests, including duplicate test check for inconsistent/illogical orders with a user defined time window shall be available. The system will allow for automatic or manual assignment of accession numbers, which will be user definable. The system will allow for specimen or aliquot labels to be printed automatically for scheduled pickups or to be printed dynamically. The system will be able to generate worksheets and work lists. Result entry format will be on line, discrete, or batched with the system being interfaced to user defined instrumentation for the laboratory at FMC Carswell, Texas. The laboratory information system will have the ability to reprint worksheets with completed tests results. Patient cumulative reports will be available upon request, in a user defined format. The system will maintain and be able to produce hard copy logs of pending tests, overdue tests, specimens, patients, results, daily activity summary, and a copy of information for C.A.P. workload recording. The system will allow the user to customize keypads for direct entry into the system of hematology differentials, and urine microcopies. A method to track the turnaround report data for times of test order to collection, collection to receipt, and receipt in laboratory to result verification and final test print will be available. Also included will be a unique defined system to track which staff member ordered, performed phlebotomy and testing, and reported patient testing. The system will allow for user controllable parameters for software to include the following for each laboratory test: order code abbreviations; test name; laboratory department; tube type and volume; reference laboratory codes; results units, laboratory staff codes and names to trace the chain of custody in the laboratory and password doctor codes and numbers, and user codes for Bureau personnel in satellite areas of our institution. Our institution must be able to customize patient reports to include the layout, headings, and vertical vs. horizontal trend analysis of the report. The laboratory information system must have the ability to capture client test orders and generate billing code reports for individualized areas. The system will include a system of password lockout security to prevent unauthorized entry and access to the system, but it shall allow for real time patient processing and laboratory patient result availability. The system will allow multi user tasking support, i.e., ability to allow multiple users to simultaneously access the system in the laboratory with no loss of response time through the use of the software, i.e. concurrent log ons to the system. The system will allow a generation of daily activity reports of laboratory by all patients accessioned and a cumulative summary of reports generated in user defined format and time frame. It shall allow a search criteria, with parameters user definable, to retrieve information for tracking and trending QC information. There will be an archival data support for a minimum of 100,000 patient reports, and unlimited number of tests per patient requisition allowed. There must be an automatic backup of data capability per C.A.P., (College of American Pathologists), requirements. The system must provide capability for real-time data extraction to allow interface with the current Medical Center network equipment. Installation must include current system data import to the new system. SOFTWARE: 5 each Bidirectional analyzer (Vitros 950, Beckman Coulter LH750, BioMerieux Vitek, Ortho Clinical Diagnostics ECI, and Bayer 500) interfaces allows LIS software to direct the operation of new generation laboratory equipment. MODULES TO INCLUDE: Cumulative reports easily tailored to the laboratory and physician?s specifications, search results by physicians, statistics by physician for purpose of utilization review, potential for out of area referral labs the abilitys to take full advantage of instrumentation, daily exception reports (all delta fails, critical values, and corrective action listed), daily report generator-automatically generates reports the same time every day, work-list; pending, complete, extensive context sensitive on-line system capabilities at each prompt, optional menu system operation according to user definition, system security module with unlimited security levels, real-time record updating, test delta-checking that alerts technologist in real-time of failed delta checks, automatic test calculations, differential counting terminal/keypad definable per user (right/left hand), extensive profile capabilities, multiple single report formats. All start up costs must be included in a proposal, to include training for laboratory staff by the vendor staff, for on site expenses, air fare, per diem, rental car, and accommodations for the vendor installation staff. The vendor staff will agree to adhere to all regulations and policies prescribed by the FMC Carswell and the Bureau of Prisons during and after the installation of the laboratory information system. It is estimated the new system will have support and be viable for a minimum of 5 years. The average life expectancy of laboratory equipment is approximately 7-10 years. SPECIAL CONTRACT REQUIREMENTS CONTRACT SECURITY INVESTIGATIVE REQUIREMENT: The employees of the contractor entering the institution shall meet certain security requirements to receive an institutional pass as required by Bureau of Prisons Program Statement 3000.02 dated November 1, 1993. Primary concerns are the amount of contact that may occur between the Contractor and his/her employees with the inmate population during the performance of the contract. The program manager at the FMC Carswell is responsible for conducting the appropriate vouchering, law enforcement checks, and ensuring that fingerprinting is completed on all Contractor staff that may need access inside the confines of the secure perimeter. The personnel department will establish a security file that will be maintained on each of the contractor's employees from the beginning of the contract through its duration. The following investigative procedures will be performed: National Crime Information Center (NCIC) check; DOJ-99 (name check); FD-258 (fingerprint check): Law Enforcement Agency checks; Vouchering of Employers; Resume/Personal Qualifications; Completed Contractor Pre-employment Form; OPM-329-A (Authority for Release of Information); National Agency Check and Inquiries (NACI) check (if applicable); and Urinalysis Test (for the detection of marijuana and other drug usage). By submitting a quotation, the contractor and its employees agree to complete the required documents and undergo the listed procedures. An individual employee of the contractor who does not pass the security clearances will be unable to perform services under the contract. If the resulting contract is to be awarded to an individual, all clearance procedures shall be applied prior to award. Individuals who do not pass the security clearance will not be awarded a contract. The final determination and completion of the security investigation procedures will be made at the sole discretion of the FMC Carswell. All persons are advised that a urinalysis test for the detection of marijuana and other drug usage shall be performed. Any person(s) testing positive shall be disqualified from performing under the resulting contract. Any individual employed by the Contractor deemed not suitable by the BOP requirements will not be granted access to perform services under the contract. This is a condition of the contract. The Contractor must be in compliance with Department of Justice regulations at 8 CFR 274a regarding the employment of aliens. A copy of this directive is available upon the Contractor's request. Contractor employees shall adhere to all institution regulations regarding conduct and performance. Contractor employees will be allowed access to the FMC Carswell at the sole discretion of the Chief Executive Officer (CEO). Any individual performing under this contract may be removed if it becomes apparent that his/her conduct does not reflect the conduct of that prescribed for those people performing under this contract. 52.233-2 SERVICE OF PROTEST (AUG 1996) (a) Protests, as defined in Section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the General Accounting Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from: Procurement Executive Federal Bureau of Prisons 320 First Street, N.W., Room 5006 Washington, D.C. 20534 (b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO. DEPARTMENT OF JUSTICE CONTRACTOR RESIDENCY/ BUREAU OF PRISONS CLAUSE (JUNE 2004) For three of the five years immediately prior to submission of an offer/bid/quote, or prior to performance under a contract or commitment, individuals or contractor employees providing services must have: 1. legally resided in the United States (U.S.); 2. worked for the U.S. overseas in a Federal or military capacity; or 3. been a dependent of a Federal or military employee serving overseas. If the individual is not a U.S. citizen, they must be from a country allied with the United States. CONTRACTING OFFICER'S TECHNICAL REPRESENTATIVE (COTR) (JAR 2852.201-70) (JAN 1985) (a) Dan Chastain of FMC Carswell, is hereby designated to act as Contracting Officer's Technical Representative (COTR) under this contract. (b) The COTR is responsible, as applicable, for: receiving all deliverables, inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual Scope of Work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment. ?) The COTR does not have the authority to alter the contractor's obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If as a result of technical discussions it is desirable to alter/change contractual obligations or the Scope of Work, the Contracting Officer shall issue such changes. PROTESTS FILED DIRECTLY WITH THE DEPARTMENT OF JUSTICE (JAR 2852.233-70) (JAN 1998) (a)The following definitions apply in this provision: (1) "Agency Protest Official" means the official, other than the contracting officer, designated to review and decide procurement protests filed with a contracting activity of the Department of Justice. (2) "Deciding Official" means the person chosen by the protestor to decide the agency protest; it may be either the Contracting Officer or the Agency Protest Official. (3) "Interested Party" means an actual or prospective offeror whose direct economic interest would be affected by the award of a contract or by the failure to award a contract. (b) A protest filed directly with the Department of Justice must: (1) Indicate that it is a protest to the agency. (2) Be filed with the Contracting Officer. (3) State whether the protestor chooses to have the Contracting Officer or the Agency Protest Official decide the protest. If the protest is silent on this matter, the Contracting Officer will decide the protest. (4) Indicate whether the protestor prefers to make an oral or written presentation of arguments in support of the protest to the deciding official. (5) Include the information required by FAR 33.103(d)(2): (I) Name, address, facsimile number and telephone number of the protestor. (ii) Solicitation or contract number. (iii) Detailed statement of the legal and factual grounds for the protest, to include a description of resulting prejudice to the protestor. (iv) Copies of relevant documents. (v) Request for a ruling by the agency. (vi) Statement as to the form of relief requested. (vii) All information establishing that the protestor is an interested party for the purpose of filing a protest. (viii) All information establishing the timeliness of the protest. (c) An interested party filing a protest with the Department of Justice has the choice of requesting either that the Contracting Officer or the Agency Protest Official decide the protest. (d) The decision by the Agency Protest Official is an alternative to a decision by the Contracting Officer. The Agency Protest Official will not consider appeals from the Contracting Officer's decision on an agency protest. (e) The deciding official must conduct a scheduling conference with the protestor within five (5) days after the protest is filed. The scheduling conference will establish deadlines for oral or written arguments in support of the agency protest and for agency officials to present information in response to the protest issues. The deciding official may hear oral arguments in support of the agency protest at the same time as the scheduling conference, depending on availability of the necessary parties. (f) Oral conferences may take place either by telephone or in person. Other parties may attend at the discretion of the deciding official. (g) The protestor has only one opportunity to support or explain the substance of its protest. Department of Justice procedures do not provide for any discovery. The deciding official may request additional information from either the agency or the protestor. The deciding official will resolve the protest through informal presentations or meetings to the maximum extent practicable. (h) An interested party may represent itself or be represented by legal counsel. The Department of Justice will not reimburse the protester for any legal fees related to the agency protest. (I) The Department of Justice will stay award or suspend contract performance in accordance with FAR 33.103(f). The stay or suspension, unless over-ridden, remains in effect until the protest is decided, dismissed, or withdrawn. (j) The deciding official will make a best effort to issue a decision on the protest within twenty (20) days after the filing date. The decision may be oral or written. (k) The Department of Justice may dismiss or stay proceeding on an agency protest if a protest on the same or similar basis is filed with a protest forum outside the Department of Justice. WRITTEN JUSTIFICATION FOR A SPECIFIC MAKE OR MODEL The Opus laboratory information systems is to be used for the analysis of clinical data generated by the clinical laboratory departments; chemistry, hematology, coagulation, serology and urinalysis. The information which includes present patient information can be down loaded to the new system. This will allow the laboratory to remain in compliance with our accrediting agency, the College of American Pathologist, i.e. CAP with respect to a two year look back at patient results and information without the added expense of maintaining an old system to meet our accrediting agencies requirements. The Opus Healthcare Solution Laboratory Information System is currently being utilized throughout other Bureau of Prisons Medical Centers and the system will effectively integrate with current laboratory data and interface other systems. The laboratory information system is a sophisticated and complex graphical user interface system. The application software is proprietary in nature, and has been validated solely on the requested hardware. The hardware must be absolutely compatible with HP-UNIX 11.0. SUBMISSION OF QUOTES All interested parties capable of providing the required equipment and software may submit a RFQ which will be considered by the agency in its final determination. All contractor responses shall be submitted to the address listed no later than September 19, 2005 at 3:00 pm central standard time. All bids shall be clearly marked with RFQ 50507-039-5. All vendors are hereby notified that if your bid is not received by the date/time and location specified in this notice, it will not be considered.
