- This is a combined synopsis/solicitation for Commercial items prepared in accordance with the format in FAR subpart 12.6 and supplemented with additional information included in this notice. This announcement constitutes the solicitation; quotations are being requested and a written solicitation will not be issued. The reference number is HQCE1P52520001. The solicitation is issued as a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular Fac 2005-05 and DFARS DCN 20050726 Edition. All responsible sources shall submit a written proposal, which will be considered. Facsimile submissions will also be accepted. The North American Industry Classification System (NAICS) code for the solicitation is 5321120. This combined synopsis/solicitation is restricted to the UK. Item/Services Description: Funding for leased vehicle (description of service below), Qty: 12 months from 1 November 2005 through 31 October 2006 DeCA VEHICLE LEASE NON-PERSONAL SERVICES: The Contractor shall provide all labor, tools, materials and transportation necessary to provide the following: 1. DESCRIPTION OF SERVICES: This contract is for the lease of two (2) each diesel powered, right hand drive tractor units with each having a hardside 40 foot long, or metric equivalent, trailer unit capable of carrying 20-ton (40,000 pounds) dry freight and with beds able to support the weight of a 4-ton (8,000 pound) forklift with a ? ton (1,000 pound) load during rear loading/off-loading from a loading platform. Vehicles are to be no older than 18 months at the commencement of the contract. Contractor shall provide service history and all documentation of vehicle inspection certificates for vehicles from new to commencement of contract. Delivery and collection point for the two tractor/trailer units will be (excluding breakdowns): DeCA UK Central Distribution Center Building 1081 RAF Lakenheath Brandon, Suffolk, IP27 9PN 1.1 MAINTENANCE REQUIREMENTS. The contractor shall provide 24 hours per day, seven (7) days per week accident and breakdown notification, and response service. Lease shall include full maintenance provision and servicing. Replacement vehicles (tractor or/and trailer) shall be provided at no additional cost, during scheduled or emergency maintenance (if requested). 1.1.1. Except as provided in para. 3, preventative maintenance and repairs to keep the vehicles in a safe operating condition shall be the responsibility of the Contractor. The Contractor shall advise the Government point of contact (POC) in advance of the maintenance dates. Disposal of used parts and fluids will be the responsibility of the contractor. 1.1.2. If a vehicle becomes inoperable due to a need for repair or maintenance, the Contractor shall provide a replacement vehicle within 3 hours of notification of a breakdown. All delivery of vehicles, and pickup and removal of inoperable vehicles, shall be the responsibility of the Contractor. 1.2 TITLE AND LICENSING. Contractor shall properly register, license and comply with all safety laws, ordinance rules and regulations specified by the British Government. (i.e. MOT and Road Tax). Title to the Contractor?s equipment and supplies shall be retained by the Contractor at all times. If option to purchase is exercised, title shall pass to the government upon completion of all transfer responsibilities by the contractor. 1.3. RISK OF LOSS OR DAMAGE. Except for the provisions in para. 3.3 and 3.4 the contractor shall bear the risk of loss or damage to the vehicles supplied under this contract, except when such loss or damage is caused by U.S. Government negligence or abuse. For Government administrative purposes only, all vehicles will be operated as Government Owned Vehicles. In the event of an accident both parties have the right to report and assess the damage. No repairs should be authorized without the agreement of the contracting officer. 1.3.1. All claims for damage caused by the negligence or fault of the Government, including reimbursement (e.g. windscreens, tires, etc.), shall be submitted to the Contracting Officer for his/her final decision in accordance with the Disputes Clause (52.233-1) in Section I. Negligence and fault do not include damage caused by ?fair wear and tear?. 2. RESERVED 3. GOVERNMENT FURNISHED PROPERTY AND SERVICES 3.1 The Government will provide all fuel, tire air, coolant water and windscreen washing liquids required to operate the vehicles furnished under this contract. 3.2 The Government will provide vehicle operator inspections and associated services (e.g. adding fuel, inflating tires, adding coolant water (excluding anti-freeze), adding windscreen washing liquids, and cleaning of interior and exterior) for the vehicles provided under this contract. 3.3 Windscreens. Damaged windscreens and body glass repairs and/or replacement will be at Government expense unless the damage is caused by a material defect for which the Contractor shall be responsible. 3.4 The Government will be responsible for repairing or replacing tires at Government expense when a tire is damaged in the day to day usage of the vehicle, unless the puncture or blowout is caused by a material defect for which the Contractor shall be responsible. 4. GENERAL INFORMATION 4.1 Workload Estimate. Each vehicle in this contract will be driven no more than 60,000 miles per year. Miles in excess will be billed annually in a detailed invoice. 4.2 Quality Control. The Government shall rely upon the Contractor to implement a commercial designed quality control program that ensures that service will be performed in accordance with this contract, commercial standards, and applicable laws. The Quality Control program should implement procedures to identify, prevent, and ensure the non re-occurrence of defective services. Quality Control procedures shall clearly present: responsibility for surveillance, a description of records to be kept, methods for identifying and preventing defects, and the availability of those records to the Government upon request 4.3 Government Quality Assurance. The Contractor?s quality control methods and findings shall be regularly surveyed by a Government representative, called a Quality Assurance Person (QAP). Quality Assurance Personnel will assess the Contractor?s performance through inspections of the actual service. The QAP will require the Contract Manager or the Contractor?s representative to acknowledge any defective quality control method or contract performance by initialing the QAP?s report of the observation. . The Government may increase or decrease the number of inspections where performance dictates. 4.4 Performance of Services During Crisis Declared by the National Command Authority or Overseas Combatant Commander. On occasion, emergency services may be required to support an activation or exercise of contingency plans. Activation of the emergency services, as declared by the Wing Commander or authorized representative, during this time shall require the Contractor to provide extra cover for the requirements. Remuneration for this service will be negotiated when contingency service is required. 4.5 Government Remedies. In the absence of negotiated remedies, the Contracting Officer shall follow FAR 52.212-4, Contract Terms and Conditions for Contractor?s failure to perform satisfactory services or failure to correct non-conforming services. The provision at 52.212-1, Instructions to Offerors - Commercial items, applies to this acquisition. Offerors shall provide a firm fixed-price offer. FAR 13.106-2, Evaluation of quotations or offerors The Government will award a contract resulting from this solicitation to the responsible offer whose offer conforming to the solicitation will provide the best value to the government. The government reserves the right to make award to other than the low bidder. Successful contractor must meet all the responsibility requirements of Subpart 9.1 of the Federal Acquisition Regulation (FAR). A written notice of award or acceptance of offer, mailed or otherwise furnished to the successful offeror, shall result in a binding contract without further action by either party. Offerors shall include with the submission of their offer a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications of Commercial Items.
