Description
Reference FAR 52.232-18, Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. STATEMENT OF WORK A. General 1. The contractor shall provide the rental of the following type of vehicles: Truck Carry All 4x2 7 passenger, Quantity 2 Truck, Pickup Compact 4x2, 4599G & U, Quantity 9 2. The vehicle(s) to be furnished under this contract shall be equipped with air conditioning systems. 3. The vehicle(s) to be furnished under this contract shall be equipped with either agasoline engine with capacity not less than 1750 ccm and 115 HP or Diesel engine with a capacity not less than 1950 ccm and 115 HP 4. The vehicle(s) to be furnished under this contract shall be in good safe and serviceable operating condition in accordance with the owner?s manual. The vehicle(s) should be no more than two (2) years old and have no more than 40,000 km on the odometer. They should also be free of all dirt inside and outside. It is the responsibility of the contractor to ensure that the vehicle(s) comply with all applicable safety laws, ordinance rules and regulations promulgated by the Federal Republic of Germany. Registration and licensing of the vehicle(s) shall be the contractor?s responsibility. 5. The contractor shall assure that all vehicles rented under this contract contain standard tools; jack, lug wrench, screwdriver, and spare wheel with mounted spare tire. The spare shall have a tire matching the tires mounted on the vehicle. The spare tire shall be inflated to the correct tire pressure. The vehicle(s) shall contain seat belts front and rear, first aid kit, and reflecting warning triangle road sign. By request of the U.S. Government POC all vehicle(s) shall be equipped by the contractor with snow/winter radial tires before, and as long as winter weather conditions prevail. Other times, all vehicle(s) shall be re-equipped with normal summer radial tires. Exchanging and storage of any tires shall be at no additional cost to the U.S. Government. 6. Maintenance and repairs, not to include operator maintenance as described in (9) below, required to keep the vehicles in safe operating condition shall be the responsibility of the contractor. All maintenance and repairs shall be performed outside of U.S. Government installations. Turn-in for service and maintenance above the level of operator maintenance shall be in accordance with the maintenance manual furnished with each vehicle. The U.S. Government POC shall turn-in vehicle(s) for maintenance and repairs at the government facility where the vehicle(s) was originally received. The contractor shall receive the vehicle(s) at this location, and shall provide a vehicle for services for every vehicle turned-in for maintenance and repairs at no additional cost to the U.S. Government. U.S. Government operators assigned to the vehicle(s) shall ensure that the vehicle(s) are returned to the contractor at the request of the contractor for service/maintenance. The contractor shall provide the U.S. Government POC a two week notice when requesting the return of vehicle(s) for service/maintenance etc. 7. The U.S. Government personnel, assigned as drivers of the rented vehicles, will be responsible for performing operator maintenance on the rented vehicles; operator maintenance shall include checking oil, tire pressure, fluid levels, refilling fuel tank, and washing the rented vehicle as necessary to maintain the delivered appearance. A need for additional motor oil between scheduled maintenance times shall be considered operator maintenance and shall therefore be the responsibility of the operator. The assigned operator shall perform operator maintenance as necessary for the vehicle. 8. Engine oil, antifreeze, transmission fluid, brake fluid and other lubricants and fluids except gasoline and incidental motor oil associated with operator maintenance (described in 5 above) needed for the operation of the vehicles shall be furnished by the contractor. The contractor and the U.S. Government shall provide a full fuel tank with each vehicle at the time the vehicle(s) are turned over to the U.S. Government or returned to the contractor. 9. If a vehicle becomes inoperable during the rental period due to the need for repair and/or maintenance (e.g., breakdown or accident), the contractor?s office shall be contacted within 24 hours by the U.S. Government POC after they are notified by the user for further instructions. The contractor in turn shall provide to the U.S. Government POC the name and location of the station providing the necessary services. The contractor shall also provide the recovery services, at no additional cost to the U.S. Government, if necessary, to bring the vehicle(s) to the contractor?s designated facility. The contractor shall ensure that maintenance representatives at outlying locations understand that the repaired vehicle(s) shall be released to the U.S. Government representative upon completion of repairs/maintenance. The contractor shall be responsible for all repairs to rented vehicles. A determination or reparability shall be made by the repair/maintenance facility within two hours of receipt of the disabled vehicle(s). If a determination is made by the repair/maintenance facility that the vehicle(s) cannot be repaired within 4 hours, the contactor shall provide a replacement vehicle(s) of the same or similar type from the same category/class at no additional cost to the U.S. Government. The replacement vehicle(s) shall be provided within 4 hours for vehicles rendered inoperable within Eifel Military Community, (EMC to include; Bitburg, Spangdahlem, and the Trier areas), and within 24 hours for vehicles rendered inoperable outside the EMC, after notification that the vehicle(s) cannot be repaired within a 4 hour period. 10. If a substitute vehicle is not provided by the contractor within the allowable time, (stated above in 9), from the time the repair/maintenance facility notified the contractor that the vehicle is not repairable within 4 hours, the vehicle shall be considered off-hire until it is replaced by a substitute vehicle or the inoperable vehicle is repaired and delivered to the parking area designated by the POC. If the inoperable vehicle is replaced with a substitute vehicle within the specified time after notification, the vehicle will be considered as having been on hire continuously. Pick-up and removal of inoperable vehicles will be accomplished by the contractor. B. Accident Report Forms : The contractor shall provide accident report forms with each vehicle upon delivery. These forms shall be in both, the English and German languages, and be kept in the vehicle glove box. Military accident report forms furnished by the U.S. Government POC shall also be kept in the vehicle. In case of an accident both forms shall be completed by the individual operating said vehicle and turned over to the POC. C. Turn over of the Vehicle(s) to the U.S. Government: The contractor shell deliver required vehicles to Spangdahlem Air Base, 52 CES, Housing Office, Building 454. Vehicle(s) shall be delivered no later than 1200 hours unless specified differently by the US. Government POC. At the time of turn over of the vehicle to the government, the contractor shall issue a rental contract in duplicate for each vehicle, in the English language, specifying as a minimum the following: The current condition of the vehicle, its engine and drive train, the type of fuel and where to add it, the correct tire pressure, a list of accessories supplied with the vehicle, specific maintenance intervals either by days or by kilometers, and the contractor's telephone numbers and address. Vehicles shall not be delivered that are going to need a German vehicle inspection (T?V) during the time of the contract. The list shall be signed and dated by both the POC and the contractor or by his authorized representative as acknowledgment that the vehicle(s) was/were received by the government in the condition as described/specified. The POC shell get one copy of the rental contract at the time of turn over and the remaining copy shall be kept by the contractor. Each rental contract will include the registration number of the vehicle, all necessary registration documents and insurance papers to allow the operator to travel freely within the lease area. The lease area should include all of Germany, Luxembourg, Belgium, The Netherlands, France, Spain, Italy, England, and Switzerland. D. Traffic Violations: The contractor shall forward all tickets for traffic violations to the U.S. Government POC within 48 hours of receipt. The U.S. Government POC will contact the using unit for the payment of any fines and resolutions of any difficulties which are required by the issued traffic ticket. E. Return of the Vehicle(s) to the Contractor 1. Upon expiration of the rental period as specified in each rental contract, vehicles will be turned over to the contractor at the designated U.S. Government installation in clean condition together with the rental contract covering each vehicle, which will be signed by the contractor, indicating acceptance in good condition except for reasonable wear and tear. The rental contract shall further state, in English, that the vehicles must be returned to the contractor in the same condition as at the time of delivery, and with a full fuel tank. Prior to turn in of the vehicle(s) to the contractor, the POC shall ensure, that all accessories received when the vehicle(s) was issued are returned with the vehicle(s). 2. The POC shall print his rank, unit, and telephone number on the rental contract and then sign and date it as acknowledgment that the vehicle was returned to the contractor. The contractor shall countersign the document as in agreement with the accuracy of the rental contract. F. Acceptance of Services 1. Deliveries of vehicle(s) to the U.S. Government and vehicle turn-ins to the contractor will be in accordance with the performance schedule in the individual call placed. When the delivery date conflicts with a German holiday, delivery shall take place on the day prior to the holiday. The performance period shall be as stated on the order or the delivery date whichever is later. Deliveries of vehicle scheduled for a US holiday shall be performed as specified by the individual call. 2. Returns to the contractor shall be in accordance with the performance schedule in the individual call. The call shall reflect only those days of U.S. Government requirement. The contractor takes responsibility for any additional days the vehicle is not retrieved past the return date specified in the call. lf the contractor cannot make pick up of the rental vehicle(s) as specified in the call due to U.S. Government caused delay, the call shall be adjusted to reflect the actual requirement of the U.S. Government. 3. Delivery of all vehicles shall take place between 0800 and 1200 hours unless otherwise specified and return of vehicles shall take place from 0800 through 1500 hours on those days specified in the individual call performance schedules.
