Description
The U.S. Department of Agriculture (USDA), Food Safety and Inspection Service (FSIS) intend to issue a purchase order on a sole source basis to Joseph Swerdzewski and Associates (JSA) to provide expert consulting services in Federal Human Resources and Labor Relations on Federal sector labor law, current case law, interpretation and application of case law to the extensive variety of situations at hand, but not limited to, new term negotiations with the Union, implementation of Human Resource (HR) Reform Initiatives, and unit representation cases based on the statutory exclusion of national security using current case precedent and exploring new case law development promoting the application of the national security exclusion to positions involved in safeguarding the food supply in today?s environment. JSA has the expertise for the critical tasks at hand without jeopardizing the Agency?s goals of negotiating an agreement with the National Joint Council (NJC) that most effectively paves the way for HR Reform within the bargaining unit and of attaining its public health mission through the exclusion of appropriate positions from the unit based on national security interests. JSA is familiar with the organizational structure and mission of the Agency from past contacts with the Agency and has qualifications as former Federal Labor Relations Authority (FLRA) General Council. JSA offers a unique array of insight and expertise that will significantly benefit the Agency as it goes before FLRA and the Federal Services Impasse Panel (FSIP) to litigate disputed contract proposals, and anticipated outcome of negotiations. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact. These capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based on responses to this notice is solely within the discretion of the Government. All responsible sources who can provide the above requirement shall submit written responses by September 20, 2005. No solicitation will be issued.
