Description
CONTRACT INFORMATION: The USDA Natural Resources Conservation Service (NRCS) in South Dakota requires the services of an Architect-Engineering (A-E) firm for the performance of legal boundary surveys. This acquisition is being conducted in accordance with the Brooks A-E Act as implemented in FAR Subpart 36.6. THIS PROCUREMENT is set aside for small business. PROJECT INFORMATION: The government contemplates the award of 1-3 indefinite delivery-indefinite quantity contracts in three areas of South Dakota resulting from this competition. The three areas consist of the following: Area 1: Buffalo, Jerauld, Sanborn, Miner, Lake, Moody, Lyman, Brule, Aurora, Davison, Hanson, McCook, Minnehaha, Tripp, Gregory, Charles Mix, Douglas, Hutchinson, Turner, Lincoln, Bon Homme, Yankton, Clay and Union. Area 2: Brown, Marshall, Roberts, Day, Spink, Clark, Codington, Grant, Hamlin, Deuel, Beadle, Kingsbury, Brookings, Campbell, McPherson, Walworth, Edmunds, Potter, Faulk, Sully, Hughes, Hyde and Hand. Area 3: Harding, Perkins, Corson, Butte, Meade, Ziebach, Dewey, Haakon, Stanley, Jones, Mellette, Todd, Bennett, Jackson, Shannon, Fall River, Custer, Pennington, and Lawrence. The initial contract period will be for one year and the government may, at its option, extend the contract to a maximum of five years by exercising each of the four one year renewal options. Work under each of the contracts will be subject to satisfactory negotiation of individual task orders. There is no guaranteed minimum for the base year or option years, if exercised. Task Orders will be negotiated as firm fixed-price procurements for individual or clusters of projects. I. OBJECTIVE The objective of this contract is to retain legal boundary surveying service for acquisitions of wetland and/or grassland easements areas including the route of ingress and egress on behalf of the United States of America, acting by and through the Natural Resources Conservation Service (NRCS), United States Department of Agriculture, pursuant to Title XII of the Food Security Act of 1985, as amended, 16 U.S.C. 3837. II. BACKGROUND The Wetlands Reserve Program (WRP), Emergency Watershed Protection Program/Floodplain (EWP/FP), the Grasslands Reserve Program (GRP), and the Farm and Ranchland Protection Program (FRPP) authorizes the acquisition of easement rights from willing landowners for the purpose of restoring and protecting wetlands, grasslands and ranchlands. The NRCS is the lead agency within the United States Department of Agriculture charged with administering these programs. III. SCOPE The Contractor shall provide legal boundary surveys of the WRP/EWP/GRP/FRPP easement area including the route of ingress and egress according to the following guidelines. Before fieldwork begins, a pre-survey site visit will occur. Attending will be the surveyor, the NRCS District Conservationist (or other NRCS official) and the landowner (representative). The surveyor will contact the local NRCS District Conservationist prior to the pre-survey site visit. During the pre-survey site visit, the proposed easement boundaries will be reviewed as will the easement access route (if the easement area isn’t adjacent to a public road). The NRCS WRP/EWP/GRP/FRPP Program Manager or District Conservationist will provide the Contractor with location maps of the WRP/EWP/GRP/FRPP easement area and access route and such other descriptive information as may be available. Only the NRCS Contracting Officer may authorize a modification to the easement area. Any variations in the number of acres surveyed should be reported to the Contracting Officer immediately. The surveyor will not modify the easement area surveyed at the direction of the landowner. Any questions regarding the easement area should be directed to the Contracting Officer, Sue Jones, at (605) 352-1213 or via fax at (605) 352-1270. Access shall be surveyed, but no monumentation is required. The survey will show both the easement and the ingress and egress route to a publicly dedicated right-of-way. The Surveyor shall prepare an appropriately scaled drawing of the survey. The survey drawing should include at a minimum, the following items: a) The record description of the property or the reference to the source of the record description on the property of which the easement is located on. The survey description of the easement. b) North Arrow c) Scale d) Bearings, azimuth or angles, and the distances for all courses. e) The central angle, length of curve and radius, and the length and bearing of chord from the beginning to end of curve for each curved common boundary line or individual boundary line. f) Basis of bearings or azimuth. g) Monuments identified as set or found along with a description of the monument. h) Area of the surveyed easement. i) Observed evidence of possession or use by others in the parcel or across any perimeter lines of the property. j) Sufficient data to indicate the theory of location applied in formulating the opinions as to the probable location of the boundaries and corners of the property. k) Name, registration number, address and phone number of the Surveyor. l) Name of the client. m) Date of the survey. n) Certification o) The surveyor will also include the WRP/EWP/GRP/FRPP contract number in the legend of the survey plat. Natural or manmade barriers, such as ditches, streams, creeks, or rivers are occasionally used as boundary lines in property descriptions. In those instances, in property descriptions where boundary lines are called for as being located at or along the centerline of a ditch, stream, creek, or river, for purposes of defining the WRP/EWP/GRP/FRPP easement, the surveyor shall traverse along the top of bank of such ditch, stream, creek, or river. In those cases where property descriptions call for boundary lines to be located at or along a lake, for the purposes of defining the WRP/EWP/GRP/FRPP easement, the surveyor shall traverse along the top bank of such lake or in the absence of a top bank, the surveyor shall traverse along a mark left by wave action at the preceding high water elevation, as determined by simple observation, or at the high water mark established by the State Water Management Board to establish the easement boundary line. In cases, where the surveyor is unable to determine the easement boundary line, the local NRCS District Conservationist will be contacted immediately to make this determination. Questions regarding these traverses shall be directed to the Contracting Officer. In some instances, corner points for the easement survey may be submerged. In this event, a mark left on the bank by wave action at the preceding high water, as determined by simple observation, shall be surveyed and the location for easement corners shall be mathematically offset from that line. Witness monuments shall be located on dry ground and tied to the computed points. Any suspected encroachment on the tract shall be brought to the attention of the Contracting Officer. Monuments and boundary marker posts signs shall be provided and installed by the surveyor at the time the survey is completed and prior to delivery of the plat of survey and legal description. The Surveyor will need to contact the NRCS Contracting Officer to determine if a supply of marker posts is available from the NRCS stock. If none are available, the Surveyor shall provide such marker posts. The Surveyor will be required to pick up the signs at the local NRCS office. Monuments and marker posts with sign shall be installed at each corner, angle point, road crossing, and approximately every 300 feet along the easement boundary lines. Marker posts and monuments are required at the intersection of property lines and rivers, lakes, or streams. All monuments must be thoroughly described and specifically identified as set or found, whenever shown on maps or referred to in documents prepared by the Surveyor. Descriptions of monuments must be sufficient in detail to readily facilitate future recovery by other surveyors and to enable positive identification. Acceptable monument types are: 1. Steel rebar: ½ inch diameter or larger with properly stamped survey cap. 2. Steel pipe: ½ inch inside diameter or larger with properly stamped survey cap. 3. Concrete markers: minimum of 4 inch diameter or 4 inches square buried in the ground, with a rebar or metal pipe and properly stamped cap encased in the concrete. Minimum length for all monuments is two feet. All monuments will be set flush with or below the ground surface and marked with a marker post and sign. Acceptable marker posts are: 1. “T” shaped steel fence post 1 3/8” x 1 3/8” x 1/8” or heavier. Minimum length shall be seventy-eight inches. The top six inches (6”) of the marker post shall be fluroscent orange. 2. “U” shaped metal sign post, minimum length shall be seventy-eight inches long, 1.12 lbs per foot. The top six inches (6”) shall be fluorescent orange. Marker posts shall be installed to project 4.5 feet above the ground surface. The surveyor is required to attach a WRP/EWP/GRP/FRPP boundary sign (3” x 4 ½”) to the top of the marker post using a galvanized nut and bolt or lag screw. A wire attachment is not acceptable. The WRP/EWP/GRP/FRPP sign has two 3/8 inch drilled holes. The surveyor will need to provide to the Contracting Officer: 1. One mylar and one copy (36” X 24”) signed and sealed original survey plats that meet the requirements for filing in the appropriate county land records. 2. One copy (11” x 17”) survey plat to the Contracting Officer and one copy (11” x 17”) of the survey plat to the local NRCS District Conservationist. 3. A printout of the original field notes. The survey and descriptions shall meet all requirements of South Dakota Codified Laws and be certified by a Registered Professional Land Surveyor licensed in the State of South Dakota. The relative position tolerance and traverse closure shall be twenty six hundredths of a foot (0.26) plus 200 parts per million (ppm) at the 95 percent (95%) confidence level as defined by the National Society of Professional Surveyors for Rural Surveys. The survey plat will identify monuments and list the project coordinates in the UTM 13 or 14 Coordinate System The Contractor is not to provide a copy of the survey plat to the landowner. The survey plat shall be certified by the registered land surveyor, who shall attach an official seal thereto as specified in §36-18A-45 of the South Dakota Codified Laws as being in all respects correct. The landowner, or the landowner’s duly authorized agent, shall certify that the survey plat has been made at the request and under the direction of the landowner for the purposes indicated therein, that he or she is the owner of all the land included therein, and that development of this land shall conform to all existing applicable zoning, subdivision and erosion and sediment control regulations. The landowner certification shall be acknowledged before an officer authorized to take the acknowledgment of deeds and, with the certificate of such acknowledgement, shall be endorsed on or attached to the plat and be recorded as a part thereof in the office of register of deeds of the proper county. The following shall be included in the legal description of the property: a) A clear statement of the relationship between the described property and the survey control or the basis of the unique location. b) The basis of bearings when bearings are used. c) Metes and bounds descriptions shall include bearings or angles and distances in order to allow for the computation of a mathematical closure. d) Citations to the recording information or other identifying documentation for any maps, plats or other documents referenced. e) Detailed description of any natural or artificial monument referenced. The following statement will be included on each survey: THIS IS TO CERTIFY THAT THIS SURVEY WAS DONE BY THE UNDERSIGNED, THAT THE SURVEY WAS DONE ON THE GROUND IN ACCORDANCE WITH THE MOST RECENT MINIMUM STANDARDS FOR PROPERTY BOUNDARY SURVEYS, AS SET FORTH BY THE STATE OF SOUTH DAKOTA, BOARD OF REGISTRATION FOR PROFESSIONAL ENGINEERS AND LAND SURVEYORS, AND THAT THE ACCURACY SPECIFICATION AND POSITION TOLERANCE ARE IN ACCORDANCE WITH RURAL AREA SURVEYS. SIGNATURE PROFESSIONAL LAND SURVEYOR SOUTH DAKOTA REGISTRATION NO. _________ The surveyor shall provide a digital geospatial data layer of the WRP/EWP/GRP/FRPP boundary easement layer. Projection must be defined as UTM 13 or 14 (NAD83 meters). The format will be ESRI Arc Info export (.e00) or shapefile (.dbf, .shp, .shx) in polygon format submitted to the Contracting Officer on compact disc. Upon completion, the surveyor will contact the local NRCS DC to certify that the work has been completed in accordance with NRCS’ statement of work. This certification will be made prior to any reimbursement to the surveyor. IV. CONFLICT OF INTEREST A Surveyor will not survey a WRP/EWP/GRP/FRPP easement property for a spouse, child(ren), partner(s) or business associate(s), nor have a financial interest in the real estate to be covered by the proposed easement. V. DELIVERY Delivery of the survey will be due 60 calendar days from the date of the issuance of the Notice to Proceed, unless specified otherwise in the task order. The Contracting Officer shall issue the Notice to Proceed following receipt and acceptance of a proposal from the Surveyor. Any extensions in this 60-day delivery timeline shall be obtained from the Contracting Officer in writing. VI. PAYMENT Payment will be made in accordance with FAR Clause 52.232-26, Prompt Payment for A&E Services, contained in the Contract. The Contractor will submit an invoice for payment to the NRCS Contracting Officer no later than 30-days after delivery of the survey to the Contracting Officer. Payment will be processed upon receipt of a certificate of completion by the local District Conservationist to the Contracting Officer. Payments will be direct deposited into the contractor’s account. The contractor must submit a completed SF-1199 Direct Deposit Sign-Up form to the Contracting Officer with the initial invoice for payment. VII. AUTHORITY Only the NRCS Contracting Officer may authorize a modification to this contract. All modifications will be in writing. The Surveyor will not modify the easement area surveyed at the direction of the landowner. NON-DISCLOSURE Work performance required by this SOW will involve access to potentially sensitive information about governmental and landowner issues. All Contractor personnel must comply with the terms of AGAR 452.224-70, Confidentiality of Information, as well as provisions of the Privacy Act of 1974, 5 U.S.C. 552a. Additionally, the Contractor’s employees shall comply with privacy of personal information relating to natural resources conservation programs in accordance with Section 1244 of Title II of the Farm Security and Rural Investment Act of 2002 (P.L. 1078-171). IX. CIVIL RIGHTS AND PROGRAM DELIVERY The Contractor will ensure that personnel prohibit discrimination in all aspect of programs and activities related to the Contract on the basis of race, color, national origin, sex, religion, age, disability, political beliefs, sexual orientation, or marital or family status. SELECTION CRITERIA: Selection of firms for negotiation shall be through an order of preferenced based upon demonstrated competence and qualifications necessary for the satisfactory performance of the type of professional services required. All firms responding to this announcement will be evaluated on the following factors which are shown in descending order of importance. 1) Professional qualifications necessary for satisfactory performance of the required services; 2) Specialized experience and technical competence in the type of work required; 3) Capacity to accomplish the work in the required time; 4) Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work and compliance with performance schedules; 5) Location in the general geographic area of the project and knowledge of the locality of the project. SUBMISSION REQUIREMENTS: Those firms that meet the requirements described and wish to be considered must submit 4 (four) copies of a form SF-330 for prime and any proposed sub-consultants to Vicki Supler, Natural Resoruces Conservation Service, 200 4th Street SW, Huron, SD 57350. The forms must be received in this office no later than 5:00 p.m. CT, August 12, 2005. THe SF-330 must clearly indicate the office location where the work will be performed and the qualifications of the individuals and subcontractors proposed to work on the contract and their geographical location. Firms responding to this announcement before the closing date will be considered for selection. Facsimile transmissions will be accepted at (605) 352-1270. Solicitation packages are not provided and no additional project information will be given to firms during the announcement period.
