Packaging and marking for all items are as follows: Modified commercial shipping containers shall be sealed fiberboard boxes that can adequately contain and protect the quantity and weight of its contents during the shipping process. Multiple line items can be packaged and marked separately in the same container. All shipping containers shall be marked with legible black ink in addition to Hazmat markings as required by CFR 49 Sec 4. All shipping containers shall be marked with Coast Guard Contract Number, Stock Number, Part Number, Quantity and Noun Name of each part. Failure to accomplish this, MAY result in the rejection of the delivered items. A packing list may be attached to the outside of the shipping container with marking information. Another packing list shall be included inside the container. Each item shall be individually wrapped and marked with the stock number, unit of issue, noun name of each part, Caterpillar part number, and Cage number. The Cage Number for all items under this contract is 11083. Rejection of all items under this contract requires Contracting Officer approval. The U.S. Coast Guard ELC requires the items to be manufactured under the contract are classified as Caterpillar Part Numbers. Concerns having the expertise and required capabilities to furnish the above item are invited to submit complete information discussing the same in duplicate within 5 days of this announcement. FOB Destination, delivery to USCG ELC, Warehouse Receiving Room Bldg. 88, 2401 Hawkins Point Road, Baltimore, MD 21226. Potential sources desiring to furnish other than parts described are required to submit the following information: 1) Complete and current engineering data to demonstrate the acceptability of the offered parts (i.e. salient physical, functional and serviceability characteristics) or 2) Data that the offered parts have been satisfactorily manufactured for the government or the original equipment manufacturer. This data must include sufficient information to allow the Coast Guard to evaluate the proposal relative to the above requirement. Concerns that respond to this notice must fully demonstrate the capability to accomplish the above and are to supply pertinent information in sufficient detail to demonstrate a bona fide capability to meet the requirements. Numbered Note 22 applies to this acquisition, except that award may be made within 45 days of this announcement. The award for this requirement will be based on a best value decision. Price and Delivery are the evaluation factors. This is a commercial item acquisition subject to the evaluation process outlined in FAR 13.106. Quotation shall include, proposed delivery in days, pricing for items individually packed, marked and bar coded, the company Tax Identification Number and Duns Number. Department of Homeland Security U.S. Coast Guard Engineering Logistics Center Yard Acquisition Contracting JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Solicitation Number HSCG40-06-Q-40146 Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3, CGAP 1206-3, and in accordance with requirements of FAR 6-303-2 as follows: 1. ORGANIZATION: U.S. Coast Guard Engineering Logistics Center Yard Acquisition Contracting Branch (044) 2401 Hawkins Point Road Baltimore, MD 21226-5000 2. NATURE/DESCRIPTION OF THE ACTION: This is a justification for the procurement of various Caterpillar Parts, as a commercial item acquisition, utilizing other than full and open competition procedures. The various Caterpillar Parts are for engine model numbers manufactured by Caterpillar Inc, and installed on Coast Guard vessels and application. The Coast Guard Engineering Logistics Center intends to solicit only Caterpillar Inc., and or their authorized distributors and repair facilities. 3. DESCRIPTION OF SUPPLIES/SERVICES: The Coast Guard currently has a requirement these various Caterpillar parts in accordance with current OEM specifications utilizing genuine OEM parts. The ELC anticipates awarding a firm fixed price type contract. The quantities of the Caterpillar engine parts will be addressed in the Schedule of the solicitation package. 4. STATUTORY AUTHORITY: The statutory authority permitting Other Than Full and Open Competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1 and CGAP 1206.302-190, "only one responsible source and no other supplies or services will satisfy the agency requirements". 5. APPLICABILITY OF AUTHORITY: Caterpillar Inc., is the only known company possessing the original drawings, specifications, engineering control procedures and proprietary methods to ensure the latest design configuration, manufacturing and quality control required to produce parts to current engineering specifications and requirements. 6. EFFORTS TO OBTAIN ADDITIONAL SOURCES: Documentation available is not sufficient to provide for a competitive solicitation. Caterpillar is not willing to sell the rights to its drawings and manufacturing data. Caterpillar, Inc., the OEM of the parts, has proprietary rights to the engineering drawings and specifications used to manufacture the parts. Further, the scope of manufacturing, special tools, and equipment required to manufacture the various parts are unknown. 7. FAIR AND REASONABLE COST: The Contracting Officer anticipates that the cost to the Government will be fair and reasonable based upon established catalog pricing and competition amongst their authorized dealers. Copies of the solicitation will be sent to Caterpillar, Inc., and Caterpillar authorized distributors. 8. MARKET SURVEY: a. A sources sought synopsis was advertised on the INTERNET, at Federal Business Opportunities (FEDBIZOPS) (CBD) on 09-22-05, in effort to seek maximum competition. This announcement informed the industry that it is the Governments belief that this is only available from Caterpillar Inc. authorized distributors. Organizations were invited to submit complete information discussing their capabilities in providing the brand name Caterpillar parts. No responses were received from this announcement. b. A combined solicitation synopsis was issued on 10/05/05 indicating the availability of the solicitation. Any companies responding to this notice will be added to the bidders mailing list. FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION: There are no known appropriate substitute parts for Caterpillar engine parts.
