- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Statement of Work For Removal of Hazardous Material General The contractor shall on an as required basis, supply the necessary personnel, material and other things necessary for hazardous and toxic waste disposal services for the Environmental Protection Agency, Gulf Ecology Division, 1 Sabine Island Drive, Gulf Breeze FL 32561. Services include pick-up, transportation, labeling, analyses, fate determination, documentation, and audit trails until ultimate treatment or disposal of hazardous or toxic wastes. This award will be a time and material contract and the government does not guarantee the contractor the ceiling amount on the contract. Definitions: Hazardous Material ? A substance or material, including a hazardous substance, which has been determined by the Secretary of Transportation to be capable of posing an unreasonable risk to health, safety, and property when transported in commerce, and which has been so designated. Shipping Paper ? (49 CFR 171.8) A shipping paper is a shipping order, bill of lading, manifest, or other shipping document serving a similar purpose and containing the information required by 49 CFR 172.202, 172.203 and 172.204. Hazardous Wastes Manifest ? (40 CFR 262.20) A hazardous waste manifest is a document (shipping paper) on which all hazardous waste is identified. A copy of the manifest must accompany each shipment of waste from the point of pick-up to the destination. For waste shipments, the hazardous waste manifest satisfies DOT shipping paper requirements, if all DOT requirements for shipping papers are met. (49 CFR 172.205) Contractors Specific Tasks The contractor shall provide the services described in the statement of work during normal Federal workdays, Monday through Friday with the exception of Federal holidays. The services shall be performed between the hours of 7:30 a.m. and 4:00 p.m. The contractor shall perform all services in accordance with all applicable Federal, state and local laws and regulations, including, but not limited to those promulgated under the Resource Conservation and Recovery Act, and Toxic Substances Control Act, the Occupational Safety and Health Act, the Hazardous Material Transportation Act, Environmental Protection Agency regulations applicable to the management of all regulated and non-regulated waste chemicals, chemically contaminated equipment and samples submitted for laboratory analysis and applicable Department of Transportation regulations. The contractor shall submit copies of all permits and licenses to the contracting officer within ten (10) working days of a change in status during the life of this contract when permits or licenses are amended, renewed or replaced. The contractor shall maintain an approved list of recycling vendors, haulers and landfills in their vicinity that are authorized by the EPA or state. Pertinent Environmental Protection Agency Regulations are found in the Code of Federal Regulation, Title 40, Part 262. Recyclable Materials may include but not limited to: Spent solvents Samples Antifreeze Batteries Paint Lamps Used oil or used oil contaminated with gasoline, water, dirt, etc The contractor shall be held responsible for any fines or penalties assessed due to state, local or federal laws being violated by the contractor. The contractor shall be solely responsible for proper management of waste and responsible for any and all spills, leaks and clean up while in transit. The contractor shall clean up spills or leaks to the satisfaction of the Environmental Protection Agency and in a manner that complies with applicable Federal, state and local laws and regulations. The clean up shall be at no cost to the Environmental Protection Agency. The contractor shall report all spills and leaks regardless of their quantity to the Environmental Protection Agency no later than 24 hours after the initial telephonic report. The written report shall be in narrative form and include the following: 1. Description of the item spilled (including identification, quantity, manifest no., etc) 2. Whether amount spilled is EPA/state reportable, and if so whether it was report and to whom. 3. Exact time and location of spill including a description of the area involved. 4. Containment procedures initiated. 5. Summary of any communication contractor has with press, state officials or EPA officials. 6. Description of clean-up procedures employed or to be employed at eh site including final disposition and disposal location of spill residue. The contractor shall supply and use only equipment, material, packing, containers, labels, packing slip, Land Disposal Restriction documents, and manifests that meet all United States (U.S.) Department of Transportation (DOD), U.S. Environmental Protection Agency and state and local requirements and specifications for the packing and shipment of hazardous and waste chemicals. The contractor shall maintain a list of all supplies and material purchased for the performance of this contract. All property purchase shall be the property of the United States Environmental Protection Agency. The contractor shall adopt the Demonstrated Best Available technology (DBAT) for treatment or disposal of chemical waste as approved by the EPA. Under the terms and conditions of this contract, no chemical wastes shall be shipped to, stored in, or disposed of at any location not listed as a permitted treatment, Storage, Disposal Facility (TSDF) by the EPA. The contractor shall ensure that all personnel involved in handling and packaging the hazardous waste be trained for the level of expertise required for the proper performance of the task and in particular in the areas of chemical incompatibility, general first aid procedures and spills. Handling and personnel protective equipment shall be provide by the contractor and must be appropriate to ensure safe handling of hazardous waste. The contractor agrees that his personnel and equipment are subject to safety inspections by the Environmental Protection agency and state authorities while on Environmental Protection Agency property. The contractor shall identify each treatment, storage and disposal facility (TSDF), which may perform treatment storage, or disposal services under this statement of work. Each facility must have as a minimum, EPA RCRA interim status or state approval as a treatment or disposal facility and be in good standing with the regulatory community. The contractor agrees that no facility other than those initially approved for use under this statement of work will be used with out first obtaining the written approval of the EPA. The appropriate permit/license number, name and address of the permitting/licensing agency shall be provided. The contractor shall provide the name of any subcontractor that will be used while performing this contract. The uniform hazardous waste manifest is required for the removal from EPA property of all hazardous or toxic items. The contractor shall obtain and review all manifests for completeness and accuracy prior to removal of any hazardous or toxic wastes from EPA property. The contractor shall provide the EPA with a copy of the manifest(s), land disposal restriction notification(s) and any other shipping documents for review by the appropriate EPA official at least 24 hours prior to removal. The pickup manifest shall be reviewed and signed by the appropriate EPA service official. Completed copies of all manifests shall be furnished to the EPA as well as submitted as attachments to all invoices. Manifests shall be submitted in such a manner as to comply with the timeliness prescribed by the state and EPA regulations. The contractor shall provide the government representative with two copies of any manifest, which documents the movement of EPA waste after it has departed the EPA property with 30 calendar days after acceptance at the accepting facility. Each manifest shall be clearly and distinctly marked with the contract number. The contractor shall keep a complete audit trail for all items until final treatment/disposal is accomplished. All items collected shall be segregated and kept physically separate from any other items until the initial treatment; storage disposal facility (TAD) is reached. Item must be marked for identification. The EPA shall not furnish any equipment or personnel to assist the contractor in the performance of the contractor?s responsibilities under the contract. The contractor shall prepare all waste analysis sheets. The contractor shall not treat any hazardous waste on EPA property. Treatment is defined as any process, which meets the definition of treatment as set forth in applicable federal, state and local laws and regulations. The contractor shall provide for the proper treatment or disposal of all non-radioactive chemicals, debris, contaminated equipment, explosive/energetic materials, and biological hazardous waste/regulated medical waste as designated by the Environmental Protection Agency Environmental Compliance Officer. The contractor shall prepare a Certificate of Disposal and submit it prior to the invoice. The contractor shall submit a Certificate of Recycling of any waste that is recycled. The contractor shall pick up the waste with ten (10) working days of the Environmental Protection Agency?s government representative verbal request. The contractor shall complete a pickup report at the time of each pickup. Completed copies are to be furnished to the EPA. The contractor shall prepare a Certificate of Disposal and Certificate of Recycling. This certificate shall be submitted prior to the invoice. The invoice shall be submitted directly to the contracting officer. The contractor shall prepare and submit an annual report summarizing all hazardous waste disposals and recycling data. The report shall be submitted no later that 30 day after the period of performance ends. The contractor shall provide a hourly rate for services and the title of all individuals performing under this contract. Material cost under this contract shall be forwarded to the contracting officer prior to each removal. Price shall be approved by the contracting officer. 52.212-1 - Instruction to Offerors ?
