- NOTICE OF CONTRACT ACTION (NOCA) SYNOPSIS This is a Notice of Contract Action (NOCA) synopsis. It is the Government 's intent to negotiate with Thales-Raytheon Systems, 1801 Hughes Drive, P.O. Box 34055, Fullerton, CA, 92834-9455 for the Battle Control System-Fixed (BCS-F) Interim Contractor Support (ICS) Contract. During BCS-F ICS performance, the contractor will provide on-site support to Government personnel performing on-equipment maintenance; assist in the day-to-day maintenance and problem resolution on-site and through help desk responses; purchase and provide configuration control of spares; install and test modifications and upgrades to system hardware and software; update technical manuals and provide training associated with system upgrades/modifications; perform software maintenance, test, and release; provide plans for technical refresh and for transition to long term support. TRS is currently the incumbent contractor. The fielded BCS-F system software is proprietary to TRS. Statutory authority is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy agency requirements." The fielded BCS-F system remains proprietary to TRS and, without access to the software code and documentation, no one else can successfully perform the anticipated sustainment activities. An ESC Ombudsman has been appointed to consider and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. Before consulting the Ombudsman concerned parties should first address their concerns, issues, disagreements, and/or recommendation to the Contracting Officer for resolution. In addition, AFFARS 5352.201-9101, Ombudsman, will be included in this acquisition's solicitation and contract.
