In the event of any conflict between this BPA and RD KY AN 016(as may be modified or reissued) the terms of this BPA will control. It is possible that the instruction RD KY AN 016(as may be modified or reissued) will change during the term of this BPA. In that event the contractor guarantees that they will perform according to the new instruction, and will negotiate in good faith with the Government to arrive at negotiated changes to this BPA if changes are necessary to comply with the new instruction. A copy of instruction RD KY N 016(as may be modified or reissued) is provided as an attachment. Local offices of Rural Development, Kentucky State Office will send notice by Email, Fax, or other means to the contractor for each ad that needs to be scheduled in accordance with Exhibit D of RD KY AN 016(as may be modified or reissued). The ad shall be accompanied by a delivery ticket prepared in accordance with Exhibit F of RD KY AN 016(as may be modified or reissued). The contractor shall then create a camera ready ad copy for the paper. The contractor must instruct the newspapers to publish the ad in 8 point type and that the ??upper half?? will be in bold type. See Exhibit D of RD KY AN 016(as may be modified or reissued) for the definition of ??upper half??. The Ad copy will be provided to the local paper(s) in both hard copy and electronic format. At the same time a copy in electronic format will be sent back to the requesting local office. If the local office requires any changes to the ad, the contractor will make the changes, and provide revised ad copies to the local paper and to the Rural Development local office. An insertion order will be sent to the local papers showing the run dates for the ad to run. After placement of the ad, the contractor will gather all tearsheets for each insertion of the ad and verify that the ad was run as scheduled. An affidavit of publication is prepared by the contractor, (or by the newspaper) in accordance with Exhibit E of RD KY AN 016(as may be modified or reissued), notarized, and within 7 days after the final publication it is furnished to the Rural Development local office together with all tearsheets, and a copy of the delivery ticket on which the order was submitted by the Rural Development Local Office to the contractor. After the end of each month, the contractor will prepare and submit to the Rural Development Kentucky State Office, 771 Corporate Drive, Suite 200, Lexington KY 40503 ATTN: CONTRACTING a statement for all amounts due the contractor for ads that have completed their run. Together with each statement the contractor will furnish (each stapled together for each listing from that month) the invoice, delivery ticket, copy of affidavit of publication, and a copy of the ad that was furnished to the paper. Invoices will not be submitted for an ad that did not complete its run during the month until the monthly invoice is submitted after the end of the next month. Invoices shall be submitted no more often than once monthly. Advertisements will be prepared by the authorized ordering official in accordance with Rural Development Kentucky State Office Instruction RD KY AN No. 016 (1955 & 3550) dated June 10, 2004(as may be modified or reissued). The contractor will be notified via a delivery ticket (see Sample in Rural Development Kentucky State Office Instruction RD KY AN No. 016 (1955 & 3550) dated June 10, 2004) (as may be modified or reissued) to submit the advertisement for publication. The delivery ticket will instruct the Contractor which papers to run the ad and how many times. The cost may be distributed between different papers. The ad must be run for four (4) consecutive weeks in a local newspaper in the county in which the property is located. The contractor is responsible for ensuring that the ad is run in proper newspapers for the four (4) consecutive weeks. The contractor must notify the RDM if a proper newspaper was not selected to meet the above requirements. The RDM may also choose to run the ad in additional newspapers. Additional ads may be for less than the mandatory 4 consecutive week run in the newspaper in the county in which the property is located. If the cost will exceed $600.00 the contractor will contract the State Office Contracting Office for approval prior to running the ad. The ad may be up to 1/4 page in size. The ad should be placed in the real estate and/or business opportunities section of the paper. Either the contractor or the newspaper must prepare an Affidavit of Publication, (see sample in Rural Development Kentucky State Office Instruction RD KY AN No. 016 (1955 & 3550) dated June 10, 2004) (as may be modified or reissued). The Affidavit is mandatory. Within 7 days after the final publication the contractor shall provide to the local office the original affidavit, together with all tearsheets, and a copy of the delivery ticket on which the order was submitted by the Rural Development Local Office to the contractor. The contractor is to provide copies of the above noted documents to the State Office Contracting Section with the monthly invoice. REAL ESTATE OWNED: In some instances, it is necessary for the Government to sell owned property. Property to which Rural Development owns the deed is referred to as REO (real estate owned). The Contractor will be notified via a delivery ticket (see sample in Rural Development Kentucky State Office Instruction RD KY AN No. 016 (1955 & 3550) dated June 10, 2004(as may be modified or reissued)) to submit the advertisement for publication. The delivery ticket will instruct the contractor which papers to run the ad and how many times. Advertisements for the sale of REO property will vary in run times, but no ad will be larger than a four inch square. If the cost exceeds $600.00 the Contractor will contact the State Office Contracting Section for approval prior to running the ad. The ad should be placed in the real estate and/or business opportunities section of the paper. SECTION D FEDERAL ACQUISITION REGULATION CLAUSES INCORPORATED IN FULL TEXT 52.219-6 Notice of Total Small Business Set-Aside (June 2003) (a) Definition. "Small business concern," as used in this clause, means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation. (b) General. (1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected. (2) Any award resulting from this solicitation will be made to a small business concern. (c) Agreement. A small business concern submitting an offer in its own name shall furnish, in performing the contract, only end items manufactured or produced by small business concerns in the United States or its outlying areas. If this procurement is processed under simplified acquisition procedures and the total amount of this contract does not exceed $25,000, a small business concern may furnish the product of any domestic firm. This paragraph does not apply to construction or service contracts. (End of clause) 52.204-7 Central Contractor Registration (Oct 2003) SECTION E FEDERAL ACQUISITION REGULATION CLAUSES INCORPORATED BY REFERENCE SECTION G QUOTATION PREPARATION INSTRUCTIONS PRICE QUOTATION FORMAT The contractor??s price quotation shall be separate from the technical quotation. Prices shall be presented as a discount from (or surcharge to) each newspaper??s standard rate card. If different prices are quoted for different newspapers, they must be specified. If a constant amount is deducted from (or added to) each newspaper??s standard rate card, the amounts and any other information needed to calculate exact pricing must be provided by the quoter in their price quotation. TECHNICAL QUOTATION FORMAT The contractor shall prepare a separate Technical quotation. The technical quotation shall not include any pricing information. The technical quotation shall be prepared in two parts. 1). CAPABILITIES/QUALIFICATION STATEMENT This part shall include a description of the capabilities and qualifications of the contractor showing in their best light, why they are capable of doing the job, and why they should be considered for the work. As a part of this section, quoters are requested to submit past performance information that as closely as possible matches the scope and type of work that will be required under this BPA. 2). TEST WORK SAMPLE The quoter shall prepare a Test Work Sample and submit it as a part of their quotation. The Test Work Sample is to be prepared using the information provided in the document entitled ??Test Work Sample Source Document?? following all of the instructions presented in the Request for Quotations and attachments. Instead of sending your Test Work Sample Ad to a newspaper use the following contact information. This contact information will also be used as the contact information for the RDM (local office). It is expected that the quoter will discover any errors by following the directions provided, and will correct all of the errors in their Test Work Sample, without assistance from the Government. The quoter should provide with the Test Work Sample, a separate document showing the error(s) that they detected, and the corrective action taken. ORAL PRESENTATION As a portion of their quotation, the quoter may, at the Government??s election, be required to make an oral presentation to the Government, at the Government??s offices in Lexington, KY, at a date and time of the Government??s choosing. The major intent of the oral presentation is to answer probing questions designed to reveal the extent of the contractor??s, responsibility, capability, qualifications, experience, and understanding of the work. Standard presentations, elaborate handouts and/or audio/visuals or time consuming presentations are not wanted and may be considered to indicate the contractor??s lack of understanding of the Government??s preference for economy and efficiency. The Government may waive the requirement for an Oral Presentation on a case by case basis. SECTION H EVALUATION FACTORS FOR AWARD This Request for Quotations is a 100% Small Business Set Aside. For purposes of this solicitation the NCIAS Code is 5418. The small business size standard is average annual receipts over the last three years of $6 Million or less. In addition to price, the Government will consider other factors in selecting the contractor for award. Other factors to be considered will be past performance, capabilities, qualifications, existing arrangements with all newspapers in the Commonwealth of Kentucky, understanding of the work to be accomplished under this BPA, and results of the Test Work Sample.
