Description
Sources Sought Notice to Exchange Commodity Credit Corporation (CCC) Donated Nonfat Dry Milk (NDM) for Evaporated Milk. Description: The Kansas City Commodity Office (KCCO), Dairy & Domestic Operations Division (DDOD), is seeking qualified companies to supply approximately 10 million pounds of evaporated milk 24/12 fluid ounce can (Commodity Code B117); (hereinafter referred to as finished product) for Food and Nutrition Service (FNS) distributing agencies, in exchange for CCC donated NDM. This notice will serve as market research to obtain information for the commercial finished product sought. Information gathered from qualified suppliers in response to this Sources Sought Notice will be distributed to FNS and the Pennsylvania State Distributing Agency; (hereinafter referred to as SDA) and used solely for planning and ordering product. This notice is not a formal solicitation but a request for interested parties to provide product information. The projected timeline for delivery of finished product is April through December 2006. The SDA will contract with supplier(s) to furnish the finished product. Transfer of title of NDM will be authorized as soon as possible after a performance bond is furnished by the contractor. This will allow exchange of NDM prior to delivery of finished product. NDM will be released in store (pallet exchange basis) at the point(s) of CCC storage to the SDA and its designated supplier(s). CCC shall be responsible for any storage charges accruing up to and including the tenth day following the date of issuance of the Notice to Deliver (N/D), transfer of title in store or until the NDM is loaded out, whichever date is earlier. Any storage, handling, or other warehouse charges accruing thereafter shall be for the account of the supplier. Notwithstanding the foregoing, any prepaid warehouse charges, including loading-out charges, on any lot of the NDM released to the supplier shall accrue to the benefit of the supplier. Title and risk of loss shall pass to the supplier on the date of load-out by the warehouse operator, transfer of title in store, or ten days following the date of issuance of the N/D, whichever is earlier. The NDM donated to the SDA by CCC and released in store is projected to have a manufacture date during calendar year 2001 or 2002 and will be standard grade or better as evidenced by the most current grade certificate issued by USDA/Agricultural Marketing Service (AMS), Dairy Programs. Product delivered to the SDA must be manufactured in plants that are USDA/Farm Service Agency, Total Quality Systems Audit (TQSA) approved and certified by AMS. All quantities of finished product requested by the SDA are subject to the availability of NDM for exchange. Interested suppliers should submit the following information: Name, address, contact person, title, telephone and fax numbers, email address, and available website. Each supplier must provide product price per net pound, NDM price per net pound, a single firm-fixed exchange rate in pounds of NDM per net pound of product; quantity per case; and pallets per truckload based on FOB destination to the states listed below. Each supplier must provide product brand name, ingredients composition, nutrition facts, servings per container, shelf life, and proof of TQSA and AMS approval for product manufacturing plant, and any other information needed or requested by the SDA to place product orders. All product suppliers shall comply with all applicable Federal and State mandatory requirements and regulations relating to the preparation, packaging, labeling, storage, distribution of the product within the commercial marketplace. The delivered product shall comply with all applicable provisions of the Federal Food, Drug, and Cosmetic Act, the Fair Packaging and Labeling Act, and regulations promulgated there under. The single firm-fixed exchange rate in pounds of NDM per net pound of product will apply to the anticipated destination states: AZ, CA, CO, DC, IL, IN, IA, KS, KY, LA, MI, MN, MS, MO, MT, NE, NV, NH, NM, NY, NC, ND, OH, OR, PA, SC, SD, TN, TX, VT, WA, WI.
