Description
The United States Army Medical Research Acquisition Activity (USAMRAA), on behalf of the U.S. Army Medical Research and Material Command (USAMRMC) and the Office of the Staff Judge Advocate General (OSJA) has a requirement for patent related service s including invention disclosure development services, search services, domestic patent prosecution, foreign patent prosecution, interference services, training and education services, and licensing consultation. The Contractor shall provide services to th e OSJA. Pursuant to the Federal Technology Transfer Act (FTTA), USAMRMC has a significant program in patenting and licensing inventions with commercial potential. USAMRMC is composed of various major subordinate commands each specializing in technologies associated with its mission. USAMRMC laboratories and research and development centers work with diverse technologies including the entire breadth of biomedical and chemical research. It is expected that USAMRMC will seek to file 50-100 patent applicati ons each year and that invention disclosures will come from these and other areas. The contract will include specific task functions required to obtain a patent such as patent search, preparation, filing, and prosecution of applications, patent reviews, an d patent disclosure. The Government intends to award multiple-award Indefinite Delivery Indefinite Quantity contracts to several law firms and/or individuals with the demonstrated scientific education or experience and expertise in patent law and filing p rocedures to fulfill the frequent requirements for these patent services. The contract will be for time and materials charged to perform each task as ordered. Offers will be evaluated against FAR 52.212-2 Evaluation-Commercial Items and the Government wi ll award a contract(s) resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will represent the best value and most advantageous to the Government, price and other factors considered. The basis of award of the multiple IDIQ contracts will be according to the evaluation criteria consisting of the following factors used to evaluate offers: (1) Technical Capabilities - meets the minimum essential characteristics and features, (2) Past Performance and (3) Price. Technical and Past Performance, when combined, are twice as important when compared to price. When individual requirements arise, task orders (TO) will be solicited to at least three firms awarded IDIQ contracts. OSJA will consider available sources un der the IDIQ contract awards and issue a Task Order to the most available and suitable firm for the current requirement offering the best value for that particular action. No work may be undertaken by the Contractor without the receipt of a completed TO t hat has been signed by the Contracting Officer or by an OSJA Task Ordering Official (TOO) and approved for funding. In the event that a contractor cannot accept work, due either to time and/or resource constraints, or a professional conflict of interest, O SJA will re-assign the work to another contractor that was the next best value offer. Work will only be assigned as deemed appropriate by OSJA. The decision to assign work to a particular Contractor will be based on the Task Order Official's judgment of t he offer that represents the best value and best interest of the Government considering the Contractor's expertise, experience, strengths, and price and also the Government's programmatic goals.
