Description
The Naval Research Laboratory (NRL) intends to negotiate with Raytheon Company, 2501 W University Drive, McKinney, TX, 75071 on an other than full and open basis to increase the level of effort on contract N00173-04-C-2008. The statutory authority is 10 USC 2304(c)(1) and FAR 6.302-1 (a)(2)(iii) only one responsible source and no other supplies or services will satisfy agency requirements. The contract, awarded to Raytheon Company, 2501 W University Drive, McKinney, TX, 75071, on April 29, 2004, on a sole source basis, will continue the identical support adding approximately 100,000 hours, estimated to be $30M for an additional five years. The contract provides technical support for developing and demonstrating an Automatic Radar Periscope Detection and Discrimination (ARPDD) mode for Navy radar. The support continues the experimental programs, installation/reinstallation of the system, field engineering support, data collection, modifications of radar system software, firmware, and other hardware to implement demonstration modes and functions of the system. Additionally, this support will continue the performance studies to define future modes and functions of the system. This modification continues the third of three phases constructing Fleet Demonstrations Units for fleet evaluation. Raytheon Company has unique capabilities to support the effort required by this modification to the contract. Raytheon Company designed and fabricated the ARPDD system with associated technical data being proprietary. This continuing support consists of several equipment assemblies and massive software that includes technology for fully automatic periscope detection and discrimination. This constitutes one of a kind technology development items by Raytheon Company. Only Raytheon Company personnel have the knowledge and experience necessary to install, operate, maintain, and make necessary modifications to the ARPDD hardware and software. In order for other contractors to support the required field testing and data collection, a major training program for another contractor?s personnel would be required. The GFE one box Receiver Exciter Synchronizer (RES3) that is an integral component of the ARPDD radar system is a one of a kind unit constructed by Raytheon Company. Only Raytheon Company personnel have the knowledge necessary to integrate this equipment for special test and data collection functions. Technical data packages that would allow another contractor to bid and manufacture the APS-137, which forms the backbone of the ARPDD an Advanced profile Systems, have not been obtained by the development agency. Full data packages for the brassboard ARPDD and associated systems is not practical at this time due to continued revisions in order to test multiple functions and technical approaches. For another contractor to come up to speed on the system designs and functionality would not only be time consuming but also cost prohibitive. Award to a source other than the original source would result in substantial duplication of cost to the Government, which is not expected to be recovered through competition and would also result in unacceptable delays in fulfilling the agency's needs. This notice of intent is not a request for competitive proposals. However, all proposals received within forty-five days (thirty days if award is issued under an existing basic ordering agreement) after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. See Notes 22 and 26.
